기후변화에 관한 파리협정의 인권적 접근에 관한 소고

A Study on the Human Rights-based Approach of the Paris Agreement

기후변화는 인권을 위협한다. 2015 기후변화에 관한 파리협정은 국제기후변화조약에서 인권을 처음으로 언급하였다. 이 논문은 기후변화의 맥락에서 칸쿤협정이래 구축되어온 인권옹호주장이 파리협정 전문에 기술된 내용을 바탕으로 전문의 인권조항의 의미를 분석한다. 그리고 파리협정이 전문을 통해 국제인권법과 연결되어 있음을 확인한다. 그러나 국제인권법 체제가 갖는 한계 때문에 기후변화로 침해받는 인권을 실질적으로 보호하기 위해서 전 지구적으로 인정되는 “건강한 환경에 대한 권리”와 같은 새로운 환경적 인권의 형성이 요청되고, 파리협정하의 기후변화 대응정책에서 인권영향을 더욱 중요하게 고려하도록 영향을 미칠 것이라고 주장한다.

Climate Change is a threat to human rights. The 2015 Paris Agreement on Climate Change contains the first mention of human rights in an international climate change treaty. This article analyzes the meaning of the human rights related preambular clause of the Paris Agreement from the contents which has been established by the advocacy of human rights since the Cancun Agreement. Then, it finds that Paris Agreement is linked with the international human rights law through the expression in the preamble. Yet, due to the limits of the international human rights law system, the creation of a globally recognized new environmental human right such as “the right to a healthy environment” is required in order to substantially protect human rights against the risks of climate change. And it argues that the creation of such a new human right will affect for the Parties to more seriously consider the human rights impacts when taking action to address climate change under the Paris Agreement.
