A Study on the Real Estate Registration System in China

The most important thing in real estate transaction is on the public announcement of rights relations . In China, the main purpose of real estate registration is on its ‘public announcement’, and the most important method of the public announcement is the ‘real estate registration system’. The purpose of this paper is to study the changes and characteristics of the real estate registration system in China in order to better understand the active real estate transactions in Chinese markets since 2000. The paper introduces the three main contents regarding the real estate registration system in China. Initially, the legal changes of the real estate registration system was reviewed. In particular, the process of unified real estate registration system was explained before and after the enactment of the Real Right Law establishment in 2007. Secondly, definitions of the real estate rights and registration authority were reviewed. Lastly, characteristics of the Chinese real estate registration system were explained with comparison to the Korean system. This study provides a different perspective by systematically investigating the overall process, characteristics, and limitations of the unified real estate system settlement after the property rights law in China.
