담합 증거에 대한 실증적 검증

A Test of Cartel Evidence: The Case of Heavy-duty-truck Manufacturers

본 연구는 최근 반독점 영역에서 문제되었던 대형 화물상용차 담합 사건을 중심으로 담합 증거에 대한 실증적 검증을 수행하였다. 구체적으로, 본 연구는 담합 의심 기간 중 관련 사업자들의 가격이 실제로 부당하게 인상되었는지 여부와 관련 사업자들의 가격 간에 시기적인 선도-추종 관계가 존재하는지 여부를 확인하였다. 분석 결과는 이 담합 사건의 위법성을 인정하지 않은 최종적인 공적 판단을 지지하는 것으로 나타났다. 즉, 회귀분석 결과 담합 의심 기간 중 화물상용차 가격은 수요 또는 비용 요인에 반응하여 움직인 것으로 나타났으며 인위적으로 가격이 인상된 통계적 증거는 발견되지 않았다. 또한 Granger causality 검정 결과, 관련 사업자들의 가격에 유의한 선도-추종 관계도 확인되지 않았다. 본 논문의 분석이 담합 행위의 실재 여부에 대한 확정적 증거를 제공하지 않는다는 점은 유의할 필요가 있다. 그럼에도 불구하고 학문적으로 확립된 실증 방법론을 이용하여 담합 증거를 검증해 보는 것은 담합 위법성 여부에 대한 판단의 신뢰성을 높이는데 도움이 된다. 이러한 맥락에서 본 연구와 같은 분석, 특히 가격의 선도-추종 관계의 분석은 현실의 담합 사건에서 더욱 확산될 필요가 있다.

This paper tests the evidence of the collusive behaviors of the heavy-duty-truck manufacturers, which had received attentions in the antitrust area recently. In particular, this paper tests if the truck prices were artificially inflated during the allegedly-collusive period and if there existed a leader-follower relation between the prices of the manufacturers. The results of the test supported the ruling of the Korea Supreme Court, which ultimately denied the unlawfulness of the behaviors. The result of the regression analysis has shown that the prices responded well to the demand- or the cost-factors. On the contrary, the analysis failed to provide evidence about the artificial price-inflation during the period. The test of Granger-causality did not find either the evidence of the leader-follower relation from the manufacturers’ prices. The analysis of this paper does not provide a conclusive proof regarding the existence or the non-existence of collusion. Statistical tests of collusive behaviors nonetheless help enhancing the credibility of the legal assessment of cartels. In this context, empirical tests such as the ones in this paper, particularly the leader-follower test, need to be employed extensively in antitrust litigations.
