지방소재 법전원의 현안과 과제

The Status and Tasks of Local Law School - Focusing on Issues Surrounding Local Talents Selection System

본고는 수도권의 과도한 인구의 집중현상으로 인한 교통, 주택, 환경, 산업의 불균형 등의 문제를 해결하기 위한 하나의 방법으로 법학전문대학원에서 도입･운영되고 있는 지역인재 선발제도에 관해서 논한다. 여기서 말하는 지역인재 선발제도란 지난 2015년부터 지방에 소재한 11개 법전원이 총입학정원의 일정비율을 해당 지역 대학을 졸업한 학생들을 선발하도록 하는 제도를 말하고, 지역인재의 유출방지와 해당 지역에 정주하면서 지역발전에 공헌하도록 하기 위한 취지에서 도입된 제도이다. 그 어느 때보다도 지역인재의 육성을 통하여 지방에 소재하는 대학의 경쟁력을 강화해야 한다는 시급성이 반영되어 있는 것으로 도입의 타당성은 일면 긍정할 수 있을 것이다. 그러나 아무리 좋은 제도라 하더라도 제도도입의 취지를 살리지 못하고 오히려 법전원의 양극화를 심화시키고, 결국에는 법조인력 양성제도 자체에 나쁜 영향을 준다고 한다면 시급히 개선을 위한 재검토가 필요하다고 생각된다. 본고에서는 이러한 재검토를 위한 논의의 기초로서 첫째 지역인재 선발제도의 대상인 지역인재의 개념을 해당 지역의 고등학교 졸업자까지 확대해야 한다는 점, 둘째 지역인재 선발제도의 도입취지의 하나인 지역인재의 정주화 방안을 검토해야 한다는 점, 셋째 지역인재 선발 의무의 주체를 전체 법전원으로 확대해야 한다는 점을 제시하였다. 이러한 과제는 어디까지나 법조인력 양성을 목적으로 설립된 법전원의 성공적인 안착과 국가균형발전이라는 당위성이 조화롭게 병존해야 한다는 절박성에서 도출된 것이다.

This paper discusses on the selection system of local talent that is operated by the local law school as a way to solve the problems such as traffic, housing, environment, and industrial imbalance caused by concentration phenomenon of excessive population in the metropolitan area. The local talent selection system is a system in which the local law school will select a certain percentage of the total enrollment quota for students who graduated from the local universities since 2015. This system is introduced in order to prevent leakage of local talent and to contribute to local development while staying in the area. It is more urgent to strengthen the competitiveness of local universities through the cultivation of local talents than ever before. However, no matter how good the system is, if we can not make use of the intention of introducing the system, rather deepen the polarization of the whole law, and eventually it will adversely affect the legal manpower training system itself, it is urgently necessary to review for improvement. In this paper, as the basis for the discussion for this review, first, the concept of local talent, which is the target of local talent selection system, should be extended to high school graduates in the region. Secondly, we should consider how to put in place local talent, which is one of the intention of introducing local talent selection system. Third, we should extend the subject of selection of local talent to all the law schoool. This tasks is derived from the imperative that the successful establishment of all law school established for the purpose of cultivating the legal profession and the justification of balanced national development should coexist harmoniously.
