The Enhancement of Maritime Safety in Korea: from Risk Management and Safety Culture to Legislation

한반도를 둘러싸고 있는 인접 해양인 서해, 동중국해 및 동해는 인접 국가들의 경제발전에 따른 교역증가와 국제해상교통로의 길목이 됨에 따라 선박 교통량이 증가일로에 있으며 어업에 종사 중인 어선의 척수 또한 상당하다. 이러한 사정은 이 해역을 운항하는 선박의 안전을 전보다 더욱 위험한 상황으로 이끌고 있다. 선박의 운항은 매일 다양한 해양 위험에 직면하는 관계로 지구상 가장 위험한 산업 중의 하나로 일컬어진다. 해양에서의 사고 위험 요인들은 실제로 해양사고로 이어지는 기폭제 역할을 한다. 이 연구는 그와 같은 해양에서의 사고 위험 요인을 잘 통제하여 해상 안전을 증진시킬 수 있다는 관념에서 착수되어졌다. 이 논문은 이러한 점에 착안하여 해상에서의 사고 위험 요인을 찾아 줄일 수 있는 선제적 방식에 착안하였고 따라서 해상에서의 위험평가 기법에 초점을 맞추었으며 그러한 위험평가의 개념을 관련된 해사법규에 입안하는 방안에 대하여 연구하였다. 이 논문은 지금까지의 심각한 사고 이후 입법하는 상황과 같은 수동적인 시스템 모두를 틀렸다고 하는 것이 아니라 그러한 수동적인 시스템에 부가하여 해양사고 유발 위험요인을 사전에 제어할 수 있는 선제적 위험 거버넌스 체제를 확립할 필요가 있다고 주장하고 있다. 우리나라는 그와 같은 선제적 위험 거버넌스 체제가 제대로 작동하도록 돕기 위해 해양안전 문화의 창달 및 향상에도 주력할 필요가 있다.

Seas surrounding the Korean peninsula have become busy shipping lanes and densely fishing areas. This has made ship operations in such seas more vulnerable than before. Ship operations encounter various risks at sea on a daily basis and can be called one of the most risk-prone industries. Maritime accident risks may become initiating factors which in turn may cause accidents at sea. This study has been designed based on the idea that maritime safety can be kept through the management of accident risks at sea. This paper attempts to make an approach towards a proactive way of reducing such risks and focuses on a risk assessment method and on how to implement it on the basis of enactment of relevant provisions on risk assessment. This paper does not say that reactive systems such as ‘law-making after accidents’ are all wrong but it does say that in addition to reactive systems it is necessary to establish a proactive risk-governance system which is able to deal with risks before causing negative effects or accidents. The Korean shipping society will further need a proactive risk- governance in a way in which the culture of maritime safety is promoted.
