행정지도의 효과적 권리보호수단에 대한 일고찰

행정지도란 권고, 요망, 정보제공 등의 형태를 통하여 일정한 행정목적을 실현하기 위하여 행정기관이 상대방인 국민에게 임의적인 협력을 요청하는 비권력적 사실행위로 행정의 유연성 강화, 국민의 임의적 동의에 의한 분쟁의 예방기능 등 장점이 있으나 행 정구제수단이 미흡하다는 지적이 있다. 2014년 일본은 행정절차법 개정을 통하여 행정지도에 대한 효율적 구제수단의 일환 으로 행정지도 등의 중지신청제도 및 행정지도 등의 신청제도를 신설하였다. 즉, 행정지도 등의 중지신청제도는 법령위반행위의 시정을 구하는 행정지도의 상대 방은 당해 행정지도가 근거 법률에 규정된 요건에 적합하지 않다고 생각되는 경우 당해 행정지도의 중지 기타 필요한 조치를 취할 것을 해당 행정기관에 요구할 수 있고 이 에 행정기관은 필요한 조사를 통하여 적합하지 않다고 인정되는 경우 당해 행정지도의 중지 내지 기타 필요한 조치를 취하여야 한다. 또한 행정지도 등 신청제도는 누구든 법령위반사실을 인지한 경우 그 시정을 위하여 행하여 져야 할 행정지도가 행하여지지 아니하였다고 판단되면 당해 행정지도를 행할 권한을 가진 행정기관에 대하여 이를 할 것을 요구할 수 있고 이에 행정기관은 필요한 조사를 한 후 필요하다고 인정되는 경우에는 당해 행정지도를 하여야 한다는 것이다. 이와 같이 행정지도 자체에 대하여 일정 요건 아래 그 중지 등을 신청할 수 있는 제 도에 의하여 비권력적 사실행위인 행정지도가 그 상대방의 의사에 반하여 부당하게 강 요되는 것을 효율적으로 방지할 수 있을 것이라 판단된다. 나아가 행정지도의 시행 여 부는 행정기관의 재량이나 행정지도 등을 구하는 신청제도를 통하여 법령위반상태를 회복하여 국민의 권리ㆍ이익을 보호할 수 있을 것이다.

The Administrative Procedure Act of Korea provides administrative guidance. The term “administrative guidance” means an administrative action, such as guidance, recommendation, advice by an administrative agency to encourage or discourage a particular person regarding performance of certain acts, within the scope of duties or affairs under its jurisdiction in order to realize specific administrative aims. Admini- strative guidance shall be rendered only to the minimum extent required to attain its purpose and shall not be unjustly exercised against the will of the other party to such administrative guidance. Administrative guidance is lacking in administrative relief procedures. No administrative agency shall treat any other party to administrative guidance disadvantageously on grounds of his/her non-compliance with the administrative guidance. Japan revised the Administrative Procedure Act in 2014. Three revisions were made to administrative guidance procedures. The principle of clarity of administrative guidance, the right to request the right to apply for suspension of administrative guidance, and administrative guidance. Through this amendment, it was possible to relieve the efficient administrative guidance. It is hoped that the application for the suspension of administrative guidance and the request for administrative guidance should also be introduced into the administrative procedure law of Korea.
