The Mexican Criminal Justice System: Adversities and Reform Movement

사회가 점점 국제화됨에 따라 비교 형사사법제도와 범죄학에 대한 관심이 많이 증가하였다. 멕시코와 한국 간의 거래가 증가하고 많은 멕시코 사람들이 한국을 방문함에도 불구하고 멕시코의 형사사법 제도와 범죄 문제에 대하여 아직까지 학계에 적절하게 소개된 적이 없었다. 본 논문은 멕시코 형사사법 제도와 멕시코의 범죄 상황을 소개함으로써, 한국의 비교형사사법 연구에 도움을 주고자 하였다. 먼저 본 연구는 한국에 비하여 훨씬 심각한 멕시코 사회의 폭력범죄 상황을 설명하였다. 멕시코의 폭력범죄 상황은 마약 카르텔 문제와 이들에 대한 대응의 실패와 밀접한 관련이 있다. 비록 아주 성공적이지는 않지만, 경찰, 검찰, 법원 그리고 교정을 포함한 형사사법체계들이 지난 두 세기 동안 범죄문제를 통제하려고 많은 노력을 해왔다. 본 연구는 멕시코 형사사법체계의 문제점들과 이들에 대한 개혁 움직임에 대하여 살펴보았다. 마지막으로 본 연구는 멕시코 형사사법체계의 미래 개혁 방향과 비교형사사법 관점에서 한국에 시사 하는 점을 살펴보았다.

The comparative aspect of criminal justice system and criminology has gotten greater attention as the society becomes more globalized. Even the transactions between South Korea and Mexico have been increased dramatically and many Mexican people are visiting South Korea, the criminal justice systems and crime problems of Mexico is not appropriately introduced to the Korean academic society until now. This article tries to contribute to the comparative study of criminal justice and criminology in South Korea by introducing the criminal justice system and crime situations of Mexico. This article described, first, the current situation of violence in Mexican society, which is much worse than South Korea. Serious condition of violence is linked to drug cartels and failure of responses to those problems. Even though it was not greatly successful, the criminal justice system including police, prosecutor’s office, court and prison tried to control crime problems in Mexico through the reform movement during the past two decades. Also, this article examined the problems of Mexican criminal justice system and their reform efforts. Finally, this article proposed the future direction of Mexican criminal justice system and implications for the Korean criminal justice system from the comparative perspective.
