미국의 국가안보사범 전담 특별법원에 대한 검토

Review on the Foreign Intelligence Surveillance Court against National Security Crime in U.S.

최근 주요 안보선진국에서 국가안보를 위협하거나 헌법적 질서에 반하는 범죄를 저지르는 간첩이나 테러리즘 등 이른바 국가안보사범에 대한 사법처리절차를 살펴보면, 해당 국가 입법자들이 자국의 특수한 사정과 시대적 흐름을 고려하고, 과학기술 발전의 수준에 발맞추어 형사법체계를 지속적으로 개정 및 보완하며, 형사특별규정을 제정해서 적극적이고 합리적인 방법으로 엄중하게 처리하고 있다. 특히, 미국 사회는 1970년대 국내ㆍ외에서 보이지 않는 전쟁을 수행하기 위한 통신감청 행위가 빈번하게 발생하였으며, 해외에서의 전자감시 권한에 대한 필요성이 대두되면서 1978년 의회는 해외정보감시법(FISA)을 통과시키게 되었다. 이에 해외정보감시를 위한 별도의 법적 제도를 확립하였으며, 국가안보사범에 대한 전담 법원에 해당하는 해외정보감시법원(FISC)을 설치하여 안보전문 법관에 의한 재판을 진행하고 있다. 국가안보사범의 처리에 있어서는 국제사회에서 예외적 사항을 적극 고려하여 특별규정을 통한 형사사법절차를 진행함에도 불구하고, 국내의 경우 특별법원은커녕 전담 재판부조차 구성되어 있지 않기 때문에 그 필요성에 대한 진지한 논의가 필요한 시점이다.

In recent years, judicial proceedings against national security crimes, such as espionage and terrorism, which threaten security or commit crimes against the constitutional order in developed countries are exceptionally underway. Legislators continue to revise and supplement the criminal law system in line with the special circumstances of the country, the current trends, and the level of science and technology development, and enact special criminal laws in a strict and aggressive. In particular, American society frequently experienced interception of communications to wage invisible wars both at home and abroad. As the United States emerged in 1978 as the need for electronic surveillance power abroad, Congress passed the Foreign Intelligence Surveillance Act (FISA), established a separate legal system for foreign intelligence surveillance, and was a dedicated court for national security crimes. The Foreign Intelligence Surveillance Court (FISC) was established to conduct trials by security experts. In the handling of national security crimes, special procedures are applied in the international community, taking into account exceptional matters. Nevertheless, in Korea, it is time to seriously discuss the necessity of the special court, since there is no dedicated court.
