저작권 보호를 위한 공공대출권(PLR) 연구

A Study on Public Lending Right for Copyright Protection

공공도서관에서는 책을 무료로 빌려준다. 도서관에서 보유하고 있는 책은 누구나 무료로 빌려볼 수 있는 공공재의 성격을 가지고 있기 때문이다. 하지만 책을 무료로 빌려줄 때마다 저작자나 출판사는 판매기회를 잃게 돼 경제적 손실을 입는다. 저작자 보호와 출판업계 보호 차원에서 ‘공공대출권’ 제도는 필요하다. 대출여부와 상관없이 도서관에서 책을 보유하기만 해도 일정금액을 지불하거나, 전자도서까지 공공대출권을 확대하는 등 국가마다 시행방법은 다르지만 많은 국가가 이 제도를 도입하고 있다. 본 연구는 EU 및 선진국 일부에서 확산되고 있는 공공대출권의 운영 상황 및 문제점을 살펴보고, 아시아에서는 일본, 중국의 현황을 살펴본다. 또한 공공대출권 시행 전인 우리나라의 상황을 통하여 공공대출권에 대한 의미를 되새겨보고 적절한 방안을 제안해본다. 공공대출권 논의는 두 가지 측면에서 바라볼 수 있다. 첫째, 저작권자의 권익 보호면에서 보자. 저작권자의 합법적인 권익을 보호해 저자의 적극적인 창작 의욕을 불러 일으킬 수 있다. 둘째, 문화진흥 차원에서 보자. 문화를 보호하고 문화 지원 프로젝트를 활성화시켜 문화콘텐츠 산업의 발전을 추진 할 수 있다.

Public libraries lend free books to people. The library’s books have the characteristics of a public utility that can lend freely to anyone. However, whenever a book is lent free, the author or publisher loses the opportunity to sell the book because it loses financial damage. It is necessary to draw up public lending right system to protect the authors and publishers. The ‘public lending right’ system is needed to protect the authors and publishers. Regardless of whether the library is secured or not, the library has a public right to pay a certain amount of money to the creators or producers. Other than that, they are expanding e-book. Although these methods differ in implementation methods, many countries adopt the system. As a matter of fact, this study would like to explore the public relations of England, Japan, and China. Currently, the South Korea will review the situation in which and propose a suitable joint policy for South Korea. The debate on the issue of public lending right can be viewed in two ways. The first aspect is copyright protection of holders, and the second aspect is cultural promotion. The former protects the legitimate rights of copyright holders, which can actively assist authors. The latter projects for cultural protection and cultural support. It can develop into the cultural content industry.
