The Performance and Challenges of ‘Restorative Policing’

회복적 경찰활동은 회복적 사법이 추구하는 이념과 실천전략에 근거를 둔 경찰활동의 원칙 또는 철학으로, 지역사회 내 갈등 또는 범죄 발생시 경찰이 피해자와 가해자, 그리고 공동체를 함께 참여시켜 대화와 협의 과정을 통해 범죄로부터 야기된 피해를 회복하고 당사자간관계개선・갈등해결 등을 도모하여 궁극적으로 지역사회의 평온을 유지하고자 하는 경찰활동 패러다임이다. 경찰청은 기존 응보적 사법에 기초한 형사사법 시스템의 한계를 보완하고 공동체에서 발생하는 갈등이나 범죄에 대해 보다 근본적인 해결방안을 모색하기 위해 회복적 경찰활동을도입하였다. 우선 2019년 15개 경찰서를 대상으로 회복적 경찰활동을 시범운영을 실시하였으며, 2020년부터 전국적으로 확대하여 모든 경찰관서에서 회복적 경찰활동을 실시한다는 방침이다. 이에, 이 글에서는 회복적 경찰활동에 대한 이론적 논의와 외국의 운영 사례 등을 살펴보고, 2019년 경찰청에서 시행한 회복적 경찰활동 시범운영 성과를 분석하였다. 나아가, 회복적 경찰활동이 일회성 정책에 그치지 않고 새로운 경찰활동 패러다임으로 정착될 수 있도록하는데 필요한 과제들을 검토하고 개선방안을 모색해 보았다.

‘Restorative Policing’ is the principle or philosophy of police activities based on the ideology and practical strategy pursued by ‘Restorative justice’. It is a paradigm of police activities to ultimately maintain the peace of the community, when there is conflict or crime in the community, by restoring the damage caused by crime through communication and consultation processes with participation of victims, perpetrators, and community, which is driven by police, and through improving relations and resolving conflicts between the parties. National Police Agency introduced ‘Restorative Policing’ to supplement the limitation of criminal justice system based on existing ‘Retributive justice’ and to seek more fundamental solution to conflicts or crimes arising in the community. For the time being, the pilot program of ‘Restorative Policing’ was conducted at 15 different police stations in 2019 and the official program is being planned to expand nationwide from 2020 to carry out ‘Restorative Policing’ at all police stations. Accordingly, this article examined theoretical discussions and oversea cases on ‘Restorative Policing’ and analyzed the results of pilot program of ‘Restorative Policing’ conducted by National Police Agency in 2019. Furthermore, to establish ‘Restorative Policing’ not as a one-time policy but as a new paradigm in police activities, in this article, necessary tasks and improvement plans were also reviewed.
