승차공유 플랫폼에 관한 법·제도적 논의

A Legal and institutional Study on the ride sharing platform

본 연구에서는 미래를 예측하고 대비하는 차원에서 이른바, 타다사건의 1심판결의 의미와 국회 본회의에서 수정가결된 여객자동차법 개정안의 타당성 검토 등을 진행했다. 또한 과거, 우리나라에서 2015년을 전후로 이슈가 되었던 우버X의 도입논란과 함께 2017년과 2018년에 서울중앙지방법원에서 유죄취지로 벌금형을 선고함으로써 우리나라에서 정착하지 못한 우버사건에 대해서도 재조명했다. 구체적으로 제2장에서는 승차공유 플랫폼에 대해서 공유경제, 승차공유, 플랫폼 등으로 구분하여 전반적으로 개관해보고 제3장에서는 우버사건과 타다사건의 상관관계에 대해서 비교·고찰했다. 그리고 제4장에서는 국회에서 수정가결된 여객자동차법 개정안의 헌법적 타당성에 대해서 검토해보고 한계점이 있다면 어떤 방향으로 개선되는 것이 합리적인지에 대해 고민했다. 이상과 같은 연구의 진행을 위해 선행 연구된 학술자료를 검토하되, 최근 동향을 파악하기 위해 국내·외 관련 기사와 판결 및 사례 등도 폭넓게 다뤘다. 결론적으로 수정가결된 개정안은 플랫폼사업의 허용을 담고 있기는 하나, 타다 서비스와 같은 승차공유 플랫폼을 사실상 막고 있는 것이므로 4차산업혁명시대를 얘기하고있는 현시점과 더 나아가 미래를 대비해야 하는 차원에서는 법리적으로 재검해 볼 필요성이 있으므로 본 연구에서의 논의는 유의미할 것이다.

In this study, in order to predict and prepare for the future, the meaning of the so-called ‘Tada case’ and the validity of the amendment to the Passenger transport service act, amended and approved by the National Assembly, were conducted. We also looked at the ‘Uber case’, which was not settled in Korea due to the judgment of the judiciary along with the controversy of Uber X, which has been an issue in Korea in the past and around 2015. Specifically, in Chapter 2, the ride sharing platform is divided into the sharing economy, ride sharing, and platform. In Chapter 3, the correlation between the Uber and the Tada cases is compared. In chapter 4, we reviewed the constitutional validity of the amendment to the Passenger transport service act, which was revised by the National Assembly, and looked at how it would be reasonable to improve if there were limitations. In conclusion, the amendment recognizes the permission of the platform business, but since the ride sharing platform such as the Tada service is virtually prohibited, it is necessary to review legally at this point in time to prepare for the 4th industrial revolution and the future. The discussion is worth it.
