중국에서의 신방(信訪)제도를 통한 행정구제

The Administrative Relief by Letters and Visits in China

중국에서는 법적 분쟁이 발생하였을 경우 사법적 구제절차 보다는 사법외적 구제절차가 효과적인 경우가 적지 않다. 신방은 중국에 특유한 사법외적 구제 방식의 하나이다. 신방을 정의하자면, 공민과 법인 및 기타 단체가 자신의 합법적인 권리가 공권력에 의해 침해를 받은 경우에 서신과 방문을 통하여 신방기관에 침해의 사실을 보고하거나 의견을 제시하여 법적 해결을 요구하고, 이에 따른 신방기관의 직･간접적인 여러 가지 방식의 협조와 독촉 및 도움을 통하여 권리구제를 받는 중국의 법률제도라고 말할 수 있다. 중국에서는 통상의 민･형사 관련 분쟁도 그렇지만, 행정상 분쟁의 경우 그 해결에 있어 신방의존도가 더욱 두드러지는 경향을 보이고 있다. 중국도 나름대로 우리의 국가배상법, 행정심판법, 행정소송법 등과 같은 행정구제 제도를 구비하고 있음에도 불구하고 왜 인민들은 주로 신방에 의존하여 행정구제를 달성하려고 하는 것일까? 본 논문은 이러한 문제의식에서 출발하여 신방제도의 등장배경 및 그 제도의 구체적 내용, 신방제도의 공과 및 존폐논쟁을 살펴본다. 이어 행정소송을 중심으로 현재 중국행정구제 제도에 존재하는 문제점 및 그 과정에서 신방이 담당하는 역할을 살펴보고, 끝으로 중국 사법제도의 위와 같은 현황이 우리에게 주는 시사점을 고찰하는 것을 그 주요 내용으로 하고 있다.

When a legal dispute arises in China, a non-judicial relief procedure is sometimes more effective than a judicial relief procedure. Unique to China, Letters and Visits is one of the non-judicial remedial procedures. Letters and Visits is defined as a Chinese legal system by which a citizen, a corporation, and an agency can report the infringement of their legal rights by the public power to the institution of petition (Letters and Visits), advance an opinion, and request for a legal settlement and can protect and relieve their rights with various types of direct and indirect cooperation of the institution. China shows an apparent tendency for relying on Letters and Visits System more and more to seek a settlement for an administrative dispute as well as other disputes pertaining to common civil and criminal litigation. Why do the Chinese people want to achieve administrative relief through Letters and Visits System even though they have such an established administrative relief system as State Compensation Act, Administrative Appeals Act, and Administrative Litigation Act? With this critical mind, I will examine the settings for the emergence, detailed composition, merits, and dispute over the existence or abolition of Letters and Visits System. And then I will look into the current problems with the Chinese administrative relief system and the roles that Letters and Visits system plays in the process, focusing on the administrative litigations. Finally I will consider on some implications of the present judicial situation in China.
