한국 민법학에서 로마법 연구와 현대 로마법

한국 민법학계 전반은 로마법 연구에 대해 비교적 우호적인 태도를 유지하고 있다. 이 우호적인 태도는 기초 법학 내지 고전 법학에 대한 예우 차원일 수 있다. 그러나 기초 법학 내지 고전 법학에 대한 예우로 로마법 연구에 대한 우호적인 태도를 계속하여 유지하기는 힘들다. 민법학은 실용성이 강한 법학 분야이기 때문이다. 한국 민법학계 전반이 로마법 연구에 우호적인 태도를 유지하는 이유를 생각해보면, 우선적으로 설득력을 가지는 것은 한국 민법의 법사적 기초가 로마법이라는 이유일 것이다. 한국 민법 시행 60년이 지난 현재에도 한국 민법학계는 민법의 기초를 튼튼히 할 필요가 절실한 상태에 있다는 것이다. 또 다른 이유는 한국 민법학의 독자성을 확보하기 위해서 일 수 있다. 세계의 주요 민법들이 로마법에서 파생되어 변형되었고, 한국 민법이 계수한 독일 민법과 일본 민법이 그중 하나들이고, 한국 민법도 그중 하나라고 할 때, 한국 민법은 로마법 아래 동등한 여러 변형 중의 하나로서 독자성을 가질 수 있기 때문이다. 나아가 이유를 세계 민법들의 동조화 현상에서 찾을 수도 있다. 오늘날 사람들의 행위가 국경을 넘어 연결되고 있는 까닭에 세계 민법들의 동조화는 자연스런 현상인데, 로마법이 세계 주요 민법들에 공통요소로 자리하고 있는 만큼 로마법 연구가 유용한 것이다. 로마법이 오늘날에도 이렇게 세계의 민법들 사이에서 역할을 하고 있는 한, 로마법은 과거의 로마법이 아닌 현대의 로마법으로 관념될 수 있다. 그리고 이와 같은 현대 로마법 관념은 미래 로마법 관념으로 확장될 수 있다. 민법학자들은, 근대 민법학자들이 근대 사회의 필요에 맞추어 재구성한 근대 로마법과 그 영향 아래 있는 현대 로마법의 한계를 넘어, 현재와 미래에 필요한 새로운 로마법을 구성하는 일을 할 수 있는 것이다.

The Korean civil law community as a whole maintains a relatively favorable attitude toward the study of Roman law. This amicable attitude can be a courtesy to the classical law. However, The Korean civil law is one of the most practical areas among the Korean laws. It is difficult to maintain such a friendly attitude toward the Roman law on the grounds that it is the classic law. There must be a reason for that. Considering the reason why the Korean civil law community is amicable to the study of Roman law, one of the quite convincing reasons is that the foundation of Korean civil law is the Roman law. Even now, 60 years after the implementation of the Korean civil law, Korea still needs to solidify its foundation. Meanwhile, the Korean civil law community would have a favorable attitude toward the study of Roman law, even in order to secure the identity of Korean civil law. The world s major civil laws including Korean civil law have been derived and transformed from Roman law, then Korean civil law could secure its own identity through joining in studying Roman law. However, these days, the main reason of the friendly attitude might be found in the phenomenon of harmonization of civil laws around the world. Since people are interconnected across borders, the harmonization of world civil laws is a natural phenomenon. As far as Roman law can be used to explain the harmonization, every each civil law around the world has to deal with Roman law as ‘current and modern’ Roman law. Such a notion of current and modern Roman law does not only count for the continental European civil laws, but also true to the british common law and the american common law. Actually the Roman law tradition in the common laws is more like the original form of Roman law in its core parts. Therefore, the greater the significance of Korea in the world increases, the more the Korean civil law community needs to be active in Roman law study.
