매장문화재 훼손 ․ 파괴에 대한 처벌제도의 개선 필요성과 방향

A Necessity for Improvement of Punishment System Against Damage and Destruction of Archaeological Heritage and Its Improvement Direction

매장문화재는 한번 훼손 파괴되면 원형 그대로의 복원이나 회복이 불가능하거나 오래기간의 시간이 필요하며, 현재 우리가 갖고 있는 지식이나 과학기술 수준 등으로는 완벽한 복원이나 회복에 한계가 있을 수밖에 없다. 매장문화재 보호 보존은 우리나라 최고 상위법인 헌법에서 규정하고 있는 국가의 당연한 책무이며, 국민은 국가의 매장문화재 보호 보존 정책과 제도에 적극적으로 협조해야 할 의무가 있다. 제도와 정책은 매장문화재 보호 보존을 위한 출발점이자 기초이며, 매장문화재 보호 보존은 사회 공동체 구성원 모두의 자발적이고 헌신적인 노력과 인식이 기본적으로 뒷받침되어야 가능하다. 하지만 매장문화재의 가치와 보호 보존의 중요성에 대한 사회적 인식 부족, 매장문화재 보호 보존을 위한 체계적 예방적 관리시스템과 제도적 장치의 미흡 등으로 인해 매장문화재가 불법 훼손 파괴되고 있으며, 제도의 실효성과 규범력이 발휘되지 못하고 있는 실정이다. 따라서, 매장문화재 불법 훼손 파괴 행위에 대한 경각심을 일깨우고, 제도와 정책의 실효성 및 규범력을 강화하기 위해서는 위반 행위에 대한 형벌과 함께 사업상 제한을 가해야한다. 개발사업 시행자의 의무위반과 행정명령 미준수, 발굴조사 방해, 매장문화재 조사기관에 피해 불이익을 주는 행위 등에 대해 위반 행위 횟수와 정도에 따라 가중처벌(加重處罰)을하거나 과태료를 부과하고, 중요 사항에 대해서는 형벌을 부과하는 등 구체성과 명확성이 확보될 수 있도록 처벌제도를 전면적으로 개선할 필요가 있다.

Once the archaeological heritage is damaged or destructed, it would be impossible to restore the original state perfectly or it would take a long time for restoration. With the knowledge and scientific technology of current times, there is a limitation for a perfect restoration. Protection and preservation of archaeological heritage is a given obligation of the country and people have an obligation to actively cooperate with the systems and policies of protection and preservation of archaeological heritage. System and policy are a starting point and basis for the protection and preservation of archaeological heritage, which could be achieved through the voluntary dedication, efforts, and recognition of all members of a social community. However, due to the lack of social recognition on the value and importance of the protection and preservation of archaeological heritage, and deficiency of systematic and preventive management system and institutional devices, some of the archaeological heritage are illegally damaged and destructed, and the effectiveness of the system and regulatory power are not properly working. In order to raise awareness of illegal damage and destructive activities of archaeological heritage and intensify the effectiveness and regulatory power of the system and policy, punishment on the illegal activities along with restrictive measures in business should be provided. It is necessary to improve and arrange the punishment system in full scale toward the direction to secure concreteness and clarity by providing aggravated punishment according to violation frequency and degree against breach of obligations and failure in compliance to administrative orders by developers, disturbing excavation research, and the activities to give harm to research institutes of archaeological heritage.
