장애아동에게 학대경험은 치명적인 상처를 가져올 수 있다. ‘장애아가 학대받지 않을 권리’가 선언적인 당위성에 머물지 않고 현실적인 힘을 갖기 위해서는 장애아 학대를 사회적인 문제로 인식하고 체계적이고 제도적으로 접근하는 노력이 필수적이다. <도가니>이후 최근 들어 부척 장애아동 학대, 성폭력에 관심을 갖고 있다. 발달장애인법’, ‘장애아동복지지원법’등 장애아동의 발달능력을 고려한 각종 법적·정책적 조치가 나날이 속속 이루어져 갈 것으로 기대하지만, 이러한 노력과 동시에 장애아동을 대상으로 하는 성폭력에 대한 법제정과 조항이 제정될 필요가 있다.

In order for ‘Disabled Children’s Right not to be Abused’ to have a practical power without staying in the proclamatory appropriateness, it is essential to perceive the disabled children abuse as a social problem and approach systematically and institutionally. The point that disabled children abuse is not even grasped should be improved for the disabled children’s human rights and at the same time it needs to establish laws and provisions against the disabled children sexual violence.
