중국의 지적재산권 정책에 관한 연구

A Study on the Policy of Intellectual Property Rights in China

최근 중국 내 지적재산권이 중요해짐에 따라 중국의 지적재산권 보호제도 및 법⋅제도적 문제점 등과 같은 관점에서의 연구가 진행되었다. 하지만, 최근 중국 중앙 정부가 법⋅제도적 정비에 박차를 가하고 있는 시점에서 중앙 정부 관점에서 지적재산권에 관한 입장, 노력, 성과. 한계점 등에 관한 연구는 매우 미흡한 실정이다. 그럼으로 본 연구는 중국 중앙정부가 바라보는 지적재산권 침해의 사회적 편익과 비용에 관한 이론적 배경을 살펴보았다. 또한 중국 중앙정부의 지적재산권 보호 강화의 촉진 동인이 무엇인지에 대한 내용을 다루었다. 이와 더불어 지적재산권 보호를 위해 중국 중앙정부는 어떠한 노력을 하고 있는가에 대해 법⋅제도적⋅정책적 관점에서 논의하였다. 마지막으로 중앙정부의 지적재산권 보호 성과 및 한계점에 대해 논의하였다.

Recently, a variety of previous literatures related to problems of Chinese intellectual property right policy have been conducted. But, at this point of accelerating law system change and maintenance, there is insufficiently study on central government stance, effort, outcome and limitation of intellectual property right policy from Chinese central government perspective. Therefore, this study firstly analyzes social benefits and costs for violation of intellectual property right from the point of view of Chinese central government through literature review and theoretical background. Second, we try to find the reason why Chinese central government reinforces protection of intellectual property right. Third, we discuss efforts of Chinese central government in order to protect intellectual property right. Finally, last part include outcomes and limitations of policy of intellectual property right protection.
