범죄수사상 생체정보의 수집 및 활용에 대한규범적 통제

A study on the Normative Control over Collection or Utilization of Bio-Information for the Crime Prevention

‘생체정보(Biometric Information)’란, 사람의 고유한 신체적･행동적 특징을 기반으로개인의 신원을 확인하거나 특정할 수 있는 있는 일체의 정보(예컨대, 지문･서명･정맥패턴･얼굴･음성･홍채･유전자 등)를 말하는데, 현재 범죄예방 및 수사목적으로 활용되고 있는 생체정보 중 「디엔에이신원확인정보의 이용 및 보호에 관한 법률」에 규율되는DNA정보 외에는 그 밖의 생체정보(지문, 얼굴영상정보)의 수집 및 활용에 관한 명확한법률적 근거가 없는 상황이다. 이처럼 생체정보의 수집 및 활용에 관한 법률적 근거가없거나 불명확하다는 점은 지나치게 활용가치 및 효율성 측면에서만 접근함으로써 생체정보의 보호에 미흡하다는 점을 말해준다. 따라서 민감정보인 동시에 고유식별정보의 성격을 갖는 생체정보의 정보적 특수성을고려한다면, 설사 범죄예방 및 수사 목적의 생체정보 활용과 관련해서는 ‘범죄수사’라는 목적의 정당성이 인정된다 하더라도 정보수집의 대상과 범위, 수집방법이나 수단 그리고 정보보관의 주체 및 활용의 한계 등에 관한 명확한 법률적 근거가 시급히 마련될필요성이 있고, 더 나아가 구체적인 법률적 근거를 바탕으로 ‘범죄예방 및 수사’라는 목적을 위해 예외적으로 생체정보의 수집/보관/처리/이용을 허용한다고 하더라도 그 활용의 범위와 한계 등은 엄격한 비례성 기준에 의해서 통제되어야 한다.

Bio-information (biological information) is derived from the analysis of a range of physical or biological characteristics of a person, such as fingerprint, venation pattern, face characteristic and contour, voice, iris, and gene. The problem is that there is no clear legal basis to collect and utilize of biological data for the crime prevention, save for 「the Use and Protection of the DNA Identification Information Act」. This lack of legal grounds implies that the efficiency and utility value of information in application of bio-information only highlighted. Therefore, considering the special characteristics of bio-information as highly sensitive and personally identifiable information, (even if the justification of the purpose is recognized) the investigative agency or national organization should be exceptionally allowed to collect and utilize bio-information in the rigid principle of proportionality.
