건설산업에서 입찰담합 규제의 개선에 관한 고찰

A Study on the Improvement of the Bid Rigging Regulation in the Construction Industry

최근 건설산업 분야에서 입찰담합에 대한 규제가 증가하고 있다. 특히 공공발주사업의 입찰 과정에서의 담합에 대한 규제 사례가 증가하고 있는 것은 건설산업에서 오랫동안 지속되어 왔던 위법한 관행에 대한 적극적인 대응한 결과로 볼 수 있을 것이다. 입찰담합이 경쟁질서에 미치는 부정적인 영향이 크다는 점에서, 이와 같은 경향에 대하여 긍정적인 평가가 가능할 것이다. 그러나 입찰담합은 경쟁정책 외에 다양한 사회적 이익과 관련되며, 특히 공공발주사업의 경우 이러한 특징이 더욱 부각된다는 점에도 주목할 필요가 있다. 이러한 특징으로 인하여 입찰담합에 대하여 독점규제법 외에도 국가계약법, 지방계약법, 형법 등의 법률에서 규제가 이루어지고 있다. 따라서 독점규제법을 비롯한 각각의 법률들에 의한 입찰담합 규제를 종합적으로 이해하는 것이 필요하다. 구체적으로 독점규제법상 행정적 제재인 시정조치와 국가계약법 등에 의한 부정당업자의 입찰참가 제한, 독점규제법상 과징금 부과와 사적 구제로서 손해배상청구, 독점규제법상 형사적 제재와 형법에 의한 형사 처벌 등이 종합적인 관점에서 검토되어야 한다. 이러한 관점에서 과잉 규제로서 드러나는 부분이 개선되어야 할 것이며, 또한 분산된 규제를 합리적으로 조정하고 통합할 수 있는 규제체계를 마련하여야 할 것이다.

So due to such substantial natures of bid riggings, ‘State Contract Act’, ‘Local Contract Act’ or ‘Criminal Act’ apart from Monopoly Regulation Act, which is general law for competition policy, have provided legal bases of regulations of bid riggings. Therefore it is necessary to understand the significance of the regulations of bid riggings based on these acts synthetically. In this respect the parts exposed to an over-regulation will be improved, and it should be provided a regulation system that can be reasonably adjust and integrate dispersed regulations of bid riggings.
