잃어버린 사회적 평판과 개인정보보호의 관계

웹에 공개된 정보를 온전히 삭제하지 못하는 현실에서 정보주체는 스스로 정보에 대한 자기결정을 행사할 수 없는 어려운 사정으로 빠지게 되었다. 정보주체의 의사와 관계없이 제3자가 특정 개인에 관한 글·사진 등을 웹 페이지에 올려 일반인에게 공개하는 일이 잦아지면서 또 다른 사회문제를 빚어내고 있다. 더구나 정보주체 스스로 소셜 네트워크 서비스(SNS)를 통하여 자신의 개인정보를 공개하는 경우에는 종래 개인정보 또는 프라이버시 보호와 역행하거나 처음부터 개인정보 없는 세상에서 웹 서비스의 이용을 꾀하려는 현실이기도 하다. 웹 2.0과 SNS이 하나로 모아져 정보를 제공하고 이용하는 저간의 사정 하에서 개인이 사회적 평판(social reputation)을 잃게 되는 문제에 새로운 안목을 둘 때, 그 문제의 실체가 무엇이고 해결방안을 검토하는 기초를 어디에 두어야 하는지 논의의 실마리를 찾는 것은 중요하다. 이 글은 이 분야의 연구가 일천한 국내 사정에서 연구의 첫 발을 내딛는 데에 목적을 두었다. 이 연구는 서론적 문제제기에 이어 제2장에서 타인에 의한 개인의 신상정보 공개와 프라이버시 보호의 관련성을 살펴보기 위하여 2005년 세상을 소란하게 했던 소위 ‘개똥녀’ 사건 등 네 가지 국내 사례를 소개하고, 그에 대한 규범적 의미와 쟁점을 검토하였다. 제3장에서 개인정보와 결합된 사회적 평판의 관계와 잃어버린 사회적 평판에 대한 회복의 어려움에 대하여 살펴보았다. 이러한 논의내용을 바탕으로 제4장에서 잃어버린 사회적 평판에 대한 새로운 규범체계를 세우는 방안을 검토하였다. 마지막으로 위의 논의내용을 종합하여 잃어버린 사회적 평판의 문제점을 해결하는 규범적 논의에 관한 필자의 견해를 정리하였다.

The protection of personal information(hereinafter ‘PI’) is the cornerstone of information society. The Personal Information Protection Act of Korea is playing a important role as a general law for protection of PI. Even though the legislation and the new policy regarding PI are open to the public, the leakage of PI doesn’t get reduced, and would rather make social problems. Especially young generation are now so addicted to their Social Network Service(SNS), which have and give users access the PI of others during their communications among their peers. Along with this PI, the loss of social reputation of individuals is another social problem. As far as writing(s) and/or picture(s) about the social devaluation of people are on Web pages, the posted materials keep on the Web much longer than human memory. This article is first writing for the legal study about the loss of social reputation and PI in Korea. It has a new starting issue according to the development of information society. In this study the issue is highlighted showing four examples related the PI(including privacy) and the freedom of expression, such as so called ‘dog poop girl’. And it has tried to find legal solutions, that is the recovery from losing social reputation within existing legal system. This study concluded that making policy of reputation evaluation system and its related legislative studies be needed for recovery of lost social reputation.
