A Study on the Public Decency Regulation of Saudi Arabia-Focused on Its regulation & Violation

사우디의 공서양속준수에 관한 시행령은 관광개방정책으로앞으로 많은 외국인이 방문할 것으로 예상되기 때문에 이에대비하여 사우디의 가치를 지키고 종교전통과 정서를 지키고자2019년 4월에 제정되어 2019년 9월 27일부터 시행하게 되었다. 이 시행령의 10개 조항 가운데 단 제3~6조에서만 공서양속에관한 포괄적인 내용을 다루고 있어 앞으로 사우디 사회에서발생하게 될 다양한 시행령의 공서양속 위반들은 어떻게대처할지 문화적 충돌이 일어날 가능성도 있다. 현재 위반유형을19가지로만 분류하고 있어 세계화와 인적 교류가 빈번하면서발생할 위반유형 이외의 것들을 규제할 현재 시행령이개정되거나 아니면 보다 상세히 공서위반 유형이 제시되어야하므로 하위범주인 시행규칙 제정이 될 가능성도 있다.

The article aims to study the public decency regulation of Saudi Arabia. As we know, Saudi society has already provided a mechanism to regulate the social order or good manners by religious precepts. It seems that the main reason for the enactment of this regulation is to be a measure to avoid harming traditions, emotions, and customs. The enactment of the public decency regulation of the Saudi Arabia adopts only fine system in terms of edification rather than punishment for criminals and imposes the highest fines for indecent behavior, which can be seen as an effort to protect areas related to the performance due to the influx of foreign culture. Originally in Islam, the act of destroying public order or public morals was a personal act, and the judge was able to judge according to his own conscience (تعزير ,Ta’zīr). Along with the implementation of this regulation, Saudi society is now expected to change flexibly from a rigid atmosphere by placing the public sector in the realm of misdemeanors.
