국가필수선박제도 손실보상 개선방안

The Improvement of Loss Compensation in National Necessary Shipping System

국제선박등록법 제2조에 따르면 국가필수선박은 전시사변 또는 이에 준하는 비상시에 국가경제에 필수적인 물자 및 군수물자를 수송하기 위한 국제선박으로 규정된다. 국가필수선박 손실보상제도는 국제등록선박에 승선한 외국인 선원의 임금보다 국가필수선박의 국적선원 임금이 높을 경우 차액 분을 국가에서 보상금으로 지급하는 제도를 말한다. 해운항만기능유지법 제13조 제1항 제1호에서 국가필수선박 제도 참여를 통해 발생한 손실에 대한 보상을 규정하고 있는데 현재 외국인선원과 국적선원 간의 임금차액에 대한 보상이 이루어지고 있다. 하지만 현행 사관 1명, 부원 1명에 대해 보상하는 형태는 실제 손실금액 대비 과소한 금액이라는 주장이 제기되고 있다. 본 연구의 목적은 사관 1명·부원 1명의 기존 산정방식과 부원 2명분을 보상하는 경우를 비교·분석하고 이를 통해 선사의 실제 손실금액을 보다 정확하게 반영하는 방안을 도출·제시하는 것이다. 이를 위해 한국선주협회 및 우리나라 주요 선사들과 심층인터뷰를 수행했으며, 인터뷰 결과 제도 참여 선사들은 부원 2명에 대해 보상하는 형태로 변경 시 실제 손실금액에 비해 상응하는 손실보상금이 될 수 있다고 주장하는 것으로 나타났다. 제도 참가를 꺼리는 선사들이 늘어나서 제도의 원활한 운용에 애로가 발생하는 상황에서 손실보상 금액의 현실화가 시급하다. 본 연구는 비상사태 시의 원활한 물자 수송을 지원하는 우리나라 국가필수선박제도가 경쟁력을 높이는 데 도움이 되는 구체적인 손실보상 개선방안을 제시했다는 점에서 시사점이 있다.

Purpose : The purpose of this study is to formulate concrete policies to more accurately reflect the actual loss amount of the shipping company which participates in national necessary shipping system. Research design, data, methodology : Through conducting interviews with related persons who are engaged in shipping companies, this study presented specific measures to improve loss compensation to help enhance the competitiveness of national necessary shipping system which supports the smooth transportation of goods in case of an emergency. Moreover, this study obtained actual loss compensation data and performed quantitative analysis. Results : This study confirmed claims that small compensation is currently being made against the amount of loss. Shipping companies have been reluctant to join the system due to concerns over losses incurred when they participate in the system. Conclusions : This research suggests that rather compensating wages equivalent to two members of the crew could be a realistic alternative and close to the actual loss of occurrence.
