국가계약법상 물가변동에 따른 계약금액 조정규정의 적용을 배제한 특약의 효력에 관한 판결 분석

An Analysis of the Judgment on the Effectiveness of Special Agreements Excluding the Application of Contract Amount Adjustment Regulations according to Price Changes under the National Contracts Act

국가 등과 사인과의 계약인 공공계약에서 국가를 당사자로 하는 계약에 관한 법률(이하 ‘국가계약법’) 상 물가변동에 따른 계약금액 조정규정의 적용을 배제한 특약의 효력에 관한 대법원 전원합의체 판결(대법원 2017. 12. 21. 선고 2012다74076 전원합의체 판결)의 다수의견과 소수의견의 분석, 외국의 입법레, 학설의 검토를 통해 공공계약의 법적 성격, 이 사건 특약의 효력 및 전원합의체 판결의 의미에 대해 고찰하고자 하였다.

Through analysis the recent supreme court decision which is special agreement that excludes the application of the regulation to adjust the contract amount due to inflation in national contract law, legislation of other countries and theory, I try to understand the legal nature of pulic contracts, this special contract and meaning of this supreme court decision.
