자비와 화해의 성사인 고해성사 관련 법률들에 대한 재고(再考)

Reconsideration of Laws Related to Confession, a Sacrament of Mercy and Reconciliation

2019년 6월 29일 교황청 내사원은 ｢내적 법정의 중요성과 성사의 봉인의 불가침성에 관한 공지｣를 발표하며, 현대 과학기술과 정보들이 적절한 윤리적 여과 없이 현실 세계에 유입되어 불가피하게 교회생활까지 위협하고 있음을 우려한다. 특히 자기의 사생활을 수호할 각 사람의 권리뿐만 아니라 타인이 누리는 좋은 평판을 불법적이며 회복할 수 없을 만큼 훼손하고 있다고 지적한다. 이에 가톨릭교회는 교회만이 갖는 고유한 개념인 ‘성사의 봉인’에 대한 올바른 이해와 그 중요성을 강조하게 되었다. 따라서 본 연구에서는 고해성사에 관한 몇 가지 문제제기를 통해 교회와 사목자, 그리고 고해자가 취해야 할 입장은 무엇인지 알아보았다. 특별히 국가가 지닐 수 없는 교회의 고유한 특성 중 하나로 인간의 양심과 윤리 영역, 그리고 하느님과 신자와의 내밀한 관계 영역인 내적법정과 성사의 불가침성에 대해 살펴보았다.

On 29 June 2019, the Apostolic penitentiary has proclaimed ｢NOTE OF THE APOSTOLIC PENITENTIARY ON THE IMPORTANCE OF THE INTERNAL FORUM AND THE INVIOLABILITY OF THE SACRAMENTAL SEAL｣. This Vatican’s organ points out that the right of each person to protect his privacy and the good reputation enjoyed by others are illegal and irreparably damaged. For this reason, the Catholic Church led to the emphasis of proper understanding and importance of ‘the sacramental seal’, a unique characteristics of the Church. Therefore, this study examined the position of church, pastor, and penitent by asking some questions about confession. And I examined the sacramental inviolability and the internal forum, one of the characteristics of the church that the state cannot possess, in the realm of human conscience and ethics, and the inner relationship between God and believers.
