우리는 현재 눈부신 경제성장속에 예전과는 비교할 수 없는 풍요로운 삶을 살고 있다. 또한 의학기술의 발달로 100세 시대와 그 이상을 바라보고 있다. 현대를 살아가는 모든 사람들은 건강하게 장수하는 삶을 꿈꾼다. 그러나 아무리 여러 조건들이 좋아졌다 하더라도 인간의 노화는 피할수 없는 현상으로, 그 결과 여러 질병에 노출되게 된다. 노인들은 그 중에서도 그동안의 인격적인 삶을 송두리째 파헤쳐 버리는 ‘치매’를 ‘암’이상으로 두려워하고 있다. 치매의 주요 특징은 인지기능 장애를 유발하여 상황판단 등을 어렵게 하며 이후로 더욱 악화되는 경향이 있다. 만약, 이런 증상이 자동차 운전 중에 나타난다면 당사자 본인을 포함한 다른 사람들의 생명과 재산에 중대한 위해를 가져올 것이다. 바로 이런 점이 치매환자에 대한 운전면허 제한의 필요 논거가 된다. 우리 도로교통법 제93조는 ‘치매’를 운전면허의 필요적 취소사유로 규정하고 있다. 여기서 치매의 정도는 법 문언상 중증은 물론하고 경증도 포함한다. 그러나 경증증상의 정도는 치매의 원인질환과 개인에 따라 다르고 그 발현횟수와 시기도 마찬가지다. 정보공개청구한 자료에 따르면 치매안심센터 등록 등, 그동안 치매환자로 공인되었더라도 이를 근거로 운전면허를 취소한 사례는 아직 없었다. 그러나 고령자의 자가운전에 대한 욕구와 전술한 치매의 주요 특징으로 인하여, 머지 않아 이 문제에 대한 논의를 활발히 진행할 필요성이 예상된다. 이런 상황을 대비하여 운전면허 취소처분에 대한 치매환자의 법적 적응성을 높일수 있는 법제정비가 필요하다.
We live an affluent life through high economic growth. We are also entering the age of 100 thanks to the advanced medical technology. Everyone dreams of a long and healthy life. But no matter how many conditions have improved, aging is an unavoidable phenomenon, causing exposure to various diseases. The elderly are more afraid of dementia than cancer, which digs into their personal lives. The main characteristic of dementia is that it causes cognitive impairment, making it difficult to judge the situation correctly, and it tends to worsen afterwards. If these symptoms are manifested while driving a car, the driver with the symptoms will be able to cause serious harm to another lives and other people’s prosperty, including the person himself/herself. This is the necessary rationale for limiting driver s license of dementia patients. Article 93 of our Road Traffic Act defines dementia as a necessary reason for revoking a driver s license. This law includes the minor symptoms as well as the severe symptoms. However, the degree of minor symptoms are greatly different from case to case. According to the data obtained through information disclosure, there have never been cases of revocation of driver s license because the driver is a dementia patient, although he/she is on the list of the Dementia Safety Center. However, owing to the elderly s desire for self-driving and the aforementioned major characteristics of dementia, it is expected that discussions on the issue will be active in the near future. Legislation needs to be readjusted to enhance the legal adaptability of dementia patients to cancel their driver s license, reflecting the above situation
