국내 저작권 관련 ADR의 개선방안

저작물은 인간의 사상과 감정이 독창적으로 담기는 과정을 거쳐 표현된 것이며, 현대 사회에 접어들면서 저작물은 지식재산이라는 분류로써 그 가치를 높게 인정받고 있다. 그러나 급변하는 세상에서 저작물과 관련된 분쟁은 그 해결에 있어 시의성의 문제와 연결될 수 있으며, 이로 인하여 보다 조속한 저작권 분쟁 해결이 요구되고 있다. 그럼에도 불구하고, 아직까지는 저작권과 관련된 분쟁에서도 소송이 더 선호되는 편이며, 이로 인하여 저작권 분야에서의 ADR은 아직 활성화가 되지 않은 현실에 처해있다. 한국저작권위원회는 저작권심의조정위원회라는 명칭으로 존재하던 1987년부터 저작권과 관련된 조정 업무를 수행하여 왔으나, 아직까지도 백 단위의 분쟁 조정 신청만이 접수되었다는 점은 이를 잘 보여주고 있다. 또한, 십수 년 전까지만 해도 ADR이라는 개념을 상세히 다룬 학문적 연구 성과가 소수에 불과하였으며 최근에서야 관련 연구가 조금씩 증가하고 있다는 현실은 ADR이 앞으로 양적으로든 질적으로든 더욱 활발히 논의되어야 할 것이라는 숙제를 남겼다. 다양한 분야와 연계될 수 있는 저작권 분야는 그 응용과 활용 가능성이 무궁무진하다는 점에서 여타 분야와 달리 유연한 대처를 필요로 한다. 저작권 관련 분쟁이 증가하는 추세이며 그 규모 또한 더욱 다양해진다는 점에서 ADR은 저작권의 특성인 확장성과 관련하여 저작권 분야에서 그 빛을 상당히 발할 수 있을 것이라고 본다. 또한, 시간 및 비용과 관련하여 ADR이, 그 중에서도 조정 제도가 기존의 소송 제도에 비해 대단히 주목할 만한 경제성과 효율성을 발휘할 수 있다는 점에서, 본고에서는 현재 우리나라 저작권 분야와 관련하여 시행 중인 저작권 분쟁 조정 제도를 분석하고 효율성 향상, 전문성 강화, 인식 제고 차원에서 개선 방안을 제시하고자 한다. 효율성과 관련해서는 수수료 조정과 신기술의 적극적인 활용 등으로써, 전문성과 관련하여서는 충분한 전문 인력 양성과 절차의 세분화 등으로써, 인식과 관련해서는 광범위한 홍보와 교육 확대 등으로써 그 변화를 시도해볼 수 있을 것이다.

(Copyrighted) works reflect the human’s thinking and feeling. In modern society, the works are highly valued as intellectual property. However, in the rapidly changing world, disputes related to the works can be linked with the timeliness of settlement, so a speedy resolution is needed to the copyright issue. Nonetheless, in Korea, people prefer to file a civil suit instead of other ways yet, and in this reason, ADR(Alternative Dispute Resolution) system in the copyright field is not commonplace. Since 1987, the Korean Copyright Commission has been involved in copyright-related mediation, but only hundreds of cases are received and processed in every year. Also, only few research papers which deal with the ADR of copyright in detail were published. In these days, the researches are increased, but the ADR system is still needed to be studied more active. The copyright field, which can be linked to various fields, can be applied and utilized widely, so the legal issues of copyright should be processed flexibly. The increasing trend and the diversity of copyright related disputes imply the positive future of ADR of copyright in Korea. Based on strengths of ADR compared to lawsuit system, economical and efficient, this paper analyzed current copyright dispute mediation system in Korea and proposed improvement plans based on efficiency, expertise, awareness.
