N번방 사건을 계기로 디지털 성범죄에 대한 국민적 공분이 커지고 있다. 피해자를협박하여 성착취물을 얻어낸 주범은 물론이고 일정한 비용을 지불하고 해당 채팅창에 입장한 관전자들도 별다른 죄의식 없이 범죄에 가담했고, 피해자들 중에는 미성년자도 다수 있었으며, 가해자들의 요구는 너무나 가학적이었다. 이렇듯 가해자들이대담하게 범죄를 저지를 수 있었던 것은 보안이 우수한 텔레그램과 암호화폐를 이용함으로써 자신들은 발각되지 않으리라는 믿음이 있었기 때문이다. 실제로 해외에 서버를 두고 있는 텔레그램은 그 어떤 기관의 요구에도 이용자나 통신에 대한 정보를제공하지 않는 것으로 유명하다. 또한 암호화 및 익명화를 특징으로 하는 텔레그램이나 다크웹은 기존의 수사 방식으로는 접근이 어렵기 때문에 디지털 성착취 영상물등을 불법 거래하는 데에 이용되고 있다. 폐쇄된 가상공간에서 이루어지는 디지털성범죄에 대응하기 위해서는 보다 적극적인 수사기법이 활용되어야 한다. 이에 본논문은 디지털 시대에 변화하는 성범죄의 발생 양상과 그에 대한 수사의 한계 상황을 살펴보고, 디지털 성범죄에 대응하기 위한 온라인 수색과 잠입수사의 법제화 방안을 논하고자 한다.
The public outrage over digital sex crimes is growing as the Nth Room Case becomes known. Not only the main culprits who threatened the victims to send sexual images of themselves, but also the spectators who paid a certain fee to enter the chatrooms were involved in the serious digital sexual exploitation crime without any guilt. There were many underaged girls among the victims, and the perpetrators demands were too sadistic. The perpetrators were able to commit crimes without fear because they believed that by using highly secure Telegram and cryptocurrency, they would not be discovered. Telegram, which has its servers located in foreign lands, is famous for not providing information about users or communications, no matter what the agency demands. In addition, Telegram and Dark Webs, which are characterized by encryption and anonymity, are used to illegally trade sexual images because it is difficult for investigators to access the site through the existing investigation methods. In order to cope with digital sexual exploitation in closed virtual space, more active investigation techniques should be used. This paper tries to examine the changing patterns of sex crimes in the digital age and the limitations of investigations, and discusses ways to legislate online searches and undercover investigations to counter digital sexual exploitation.
