개발권양도제(TDR) 적용을 통한 고지대 주거환경정비 가능성 분석

도시 내 기성시가지 중 주거환경이 상대적으로 열악한 고지대에 대한 주거환경정비의 필요성은 매우 높다. 그러나 고지대의 경우 경관보전을 위한 규제 등 현행제도의 틀 속에서는 주거환경정비를 위한 사업성 결여로 정비사업의 추진이 곤란하다. 따라서 고지대의 주거환경정비를 위해서는 저지대의 정비개발사업구역과 연계한 사업추진을 고려 해 볼만하다. 이것이 가능한 제도가 개발권양도제이며, 이러한 배경 하에 본 연구는 개발권양도제 적용을 통한 고지대의 주거환경정비 가능성을 연구하였다.그 결과 송출지역에서 산출된 총 개발권(송출지역 전체면적×개발가치 상실분)을 수용지역인 저지대 정비개발사업구역에 수용할 경우 수용지역의 면적이 넓을수록 송출지역인 고지대 정비필요지역의 개발권 이전에 따른 추가허용용적률이 감소하게 되는 것을 확인하였다. 따라서 고지대의 주거환경정비를 원활하게 추진하기 위해서는 수용지역의 개발부담을 줄이는 방법이 가장 우선적으로 고려되어야 하며, 이를 위해서는 개발권을 수용지역 내지 더 많은 수용지역을 확보함으로써 개발권양도제 적용이 가능하다고 분석되었다.

It is greatly needed that the opportunities for improving residential environment of the hilly areas which is relatively poorer than that of other areas in the established urban districts have to be offered. But it is very difficult to promote the improvement in the frame of current system, because there are much regulation like control imposed to preserve views in the hilly areas. Accordingly it can be considered to try projects linked with improving and developing low-lying areas for the improvement. The system to make this to be put into practice is called TDR(Transferable Development Rights). This thesis focused on the possibility to improve the residential environment of the hilly areas through making an application of TDR. When all the development rights produced from sending districts are admitted in the low-lying area to be improved and developed, it was confirmed that the wider sending districts are, the lower the extra allowable floor area ratios conforming to the transference of the rights are. So the way to reduce development allotment in receiving districts has first to be considered to promote the improvement in the hilly areas. It was consequently analyzed that TDR could be applied to the improvement by securing more development rights and receiving districts.
