학교폭력예방법 변천과정 분석

An Analysis on the Revised Process of ｢Act on the Prevention of and Countermeasures Against Violence in Schools｣

이 논문의 연구목적은 학교폭력예방법의 변천과정 분석을 통해 그 과정에서 개정된 학교폭력예방법의 주요 내용은 무엇이며, 어떤 경향성을 띄고 있는지를 밝히는 데 있다. 연구범위는 학교폭력예방법의 제정법률부터 2020년 3월 1일자로 시행되고 있는 최근 법률까지이다. 연구방법은 법률내용분석이다. 연구결과, 학교폭력예방법은 제정 이후 총 11차례 법률을 개정하였다. 10차 개정법률까지는 학교폭력을 예방하고 피해학생을 더 두텁게 보호하며, 가해학생 및 그 보호자의 선도와 조치를 지속적으로 강화하기 위한 이유에서 개정된 것이었음에 비해, 2019년 8월에 개정된 11차 개정법률은 그 전과는 달리 학교폭력 관련업무의 대부분을 교육지원청으로 이관함으로써 학교폭력 업무 과중으로 인한 일선학교의 부담을 덜어주고 학교교육을 정상화시키기 위한 동인에서 개정된 것임을 밝혔다.

The purpose of this research aimed to explore revised process, main contents and tendency of ｢Act on the Prevention of and Countermeasures Against Violence in Schools｣. The scope of this research is from 1st legislated Act to 11th revised Act that was enforced in March. 1. 2020. Study methodology is content analysis of the law. The results of this study showed that the Act revised 11th times. From the 1st legislation Act to 10th revised Act, the main contents are to prevent school violence, to protect student victims more closely, and to reinforce proper guidance and disadvantage measures to the wrongdoing students and their guardians. But, the 11th revised Act(August. 2019) was designed to lessen difficulty of the teachers.
