디엔에이신원확인정보의 채취 및 활용의 허용 여부

A Study on the Permissible of the Collection and Utilization of DNA Identification Information

최근 범죄가 지능화되면서 수사나 범죄증명에 있어서 과학적 증거의 중요성이 강조되고 있으며, 4차 산업혁명의 영향으로 과학적 증거의 객관성과 정확성이 담보되면서 수사에 있어서 과학적 증거의 활용 필요성이 점증하고 있다. 특히, 디엔에이분석은 개인식별에 있어서 가장 우수한 식별력과 신뢰성을 가진 것으로 평가되면서 수사상 중요한 증거자료로서 그 활용가치가 인정되고 있다. 반면, 디엔에이신원확인정보의 수집은 다른 범죄증거수집의 경우에 비하여 개인의 인권에 대한 침해도 크지 않다. 따라서 대부분의 국가에서는 수사에 활용할 목적으로 디엔에이신원확인정보의 채취 등에 대한 법적 근거를 마련하는 한편, 그 데이터베이스를 구축하여 운영하고 있다. 우리나라에서도 2010년 1월 25일 「디엔에이신원확인정보의 이용 및 보호에 관한 법률」을 제정하여 시행중에 있다. 그러나 디엔에이신원확인정보의 채취 및 활용은 개인의 사생활침해와 더불어 개인의 자기정보결정권을 침해할 우려가 있는 등, 헌법위반요소를 내포하고 있다는 점에서 비판적인 의견도 적지 않다. 하지만 수사실무상 디엔에이정보는 이미 범죄해결에 적극적으로 이용되고 있을 뿐만 아니라, 실제 사례에서 범죄해결에서 실효적인 성과를 도출하고 있는 것으로 나타나고 있다. 이에 본고에서는 디엔에이법을 중심으로 하여 디엔에이신원확인정보의 성격 및 수사에의 활용가능성에 대해서 살펴보았다. 이를 바탕으로 하여 디엔에이신원확인정보의 채취 및 활용에 관한 반대론에 대하여 비판적 관점에서 분석·검토함으로써 그 정당성의 논거를 제시하였다.

As crimes have recently become intelligent, the importance of scientific evidence in investigations and criminal proofs has been emphasized, and the objectivity and accuracy of scientific evidence have been guaranteed due to the influence of the Fourth Industrial Revolution, and the need to utilize scientific evidence in investigations is increasing. In particular, DNA analysis is considered to have the best identification and reliability in individual identification, and its value of use is recognized as an important evidence in investigation. On the other hand, the collection of DNA identification information does not result in significant encroachment on individuals human rights compared to other criminal evidence collections. Therefore, most countries establish and operate a database while providing legal grounds for collecting DNA identification information for the purpose of using it for investigation. On January 25, 2010, the Act on the Use and Protection of DNA Identification Information(DNA Act) was enacted in Korea. However, many critics say that the collection and utilization of DNA identification information implies elements of violation of the Constitution, such as violation of individuals privacy as well as their right to decide their own information. However, not only is DNA information already being actively used to solve crimes, but it is also shown that actual cases produce effective results in solving crimes. Therefore, I looked at the nature of DNA identification information and the feasibility of using it for investigation, focusing on the DNA Act. Based on this, the objection to the collection and utilization of DNA identification information was analyzed and reviewed from a critical point of view, suggesting the justification.
