미국 상원과 한국 지방의회 인사청문에 대한 비교 연구

A Comparative Study on the Confirmation Hearingbetween the United States Senate and the Korea Local Council

본 연구의 목적은 미국 상원과 한국에서 다수의 지방의회에서 실시되고 있는 인사청문에 대한 비교를 통하여 우리나라 지방의회의 인사청문회에 대한 이해와 개선을 하고자 한다. 우리나라의 지방자치는 1952년부터 시작되었다가 1961년 5.16군사정권에 의해 중단되었다. 그 후 1988년에 지방자치의 토대가 마련되었지만 민주화 이후 지방자치의 부활을 둘러싼 정치권의 갈등을 겪기도 하였다. 지방의회는 1991년에 구성되었으나 1995년부터 지방의회 의원과 지방자치단체장을 동시에 주민직선으로 선출하였다. 최근에 일부 지방의회는 인사청문회를 통하여 지방단체장의 독주를 견제할 수 있는 방안을 제시하고자 한다. 지방의원은 자치단체장이 임명하는 고위공직자에 대하여 도덕성과 업무수행능력이 있는지에 인사검증을 요구하고 있다. 인사청문회를 구성하는 주요 구성요소는 주체, 대상, 그리고 운영방법 등의 3가지이다. 앞으로 내실이 있는 지방의회의 인사청문회가 되기 위해서는 첫째, 인사청문회에서만이라도 지방의원들의 면책특권이 주어져야 한다. 둘째, 인사청문의 후보자에 대한 충분한 자료확보, 인사청문회의 대상과 지방의회의 임명동의권의 확대 등이 필요하다. 셋째, 인사청문회에 허위진술이나 불응에 대한 벌칙의 강화, 인사청문회 기간의 연장 등이 필요하다.

The purpose of this article is to prepare a improvement plan for the confirmation hearing of the Korea local council from a comparative study on the confirmation hearing between the United States Senate and the Korea local council. The local autonomy of Korea started in 1952, but it was interrupted by 5.16 military regime. After undergoing a political conflict with democracy, the foundation of our local autonomy settled down in 1988. The local council was composed in 1991. Since 1995, the local councilor and the local government head have been elected at the same time by inhabitants. Recently some local government heads are presenting a plan for the control of the local government head through the confirmation hearing of the local council. In the appointment of senior officials, is required the verification for morality and work performance by the local government council. The main components that make up the confirmation hearing are three including the subject, the target, and the operating method. Considering a confirmation hearing’s strong initiative in the local government, First, immunity for local councilors should be given even though the confirmation hearing of the local council. Second, it should be given to prove a sufficient personnel resources for the candidate of the confirmation hearing. Third, the strengthening of refractory penalties for a false statement, and the period extension of the confirmation hearing are required at the confirmation hearing of the local council.
