권력분립의 측면에서 본 지방의회와 지방자치단체장의 갈등과 협력

The Conflict and Corporation between Local Council and the Chief Executive of Local Government in a Viewpoint of Separation of Powers

한국 지방자치단체는 상대적으로 어느 정도의 독자성을 유지하고 있고 또한 그 운영 면에서 민주성과 효율성을 높이기 위해 기관구성을 지방의회와 지방자치단체장으로 분리하고 있기 때문에 양자는 그 태생에서부터 갈등과 협력적 관계 속에서 출발하게 되었다. 지방의회와 지방자치단체장간 갈등의 특징으로는 갈등의 복잡다양성, 조정·해결의 곤란성, 예방의 곤란성, 이해관계의 투쟁성으로 나타난다. 그리고 그 원인은 지방의회와 지방자치단체장의 권한배분, 공직자의 가치관, 이해관계 등에서 찾을 수 있다. 즉 이러한 갈등의 원인은 우선 제도적 측면에서 조직구성상의 권한관계나 업무분장에 관한 관계법령이 명확하고 구체적이지 못한데서 찾을 수 있고, 비제도적 측면에서는 양 주체간의 지방자치에 대한 이해의 부족과 개인적인 기술 및 자질의 부족에서 그 원인을 찾을 수 있다. 특히 우리나라에서는 제도적인 측면에서 법령의 부재와 미개정, 정치적 이해관계로 인한 대립, 불명확한 사무분장, 갈등조정제도의 문제, 의회사무 직원의 임명 등을 둘러싼 문제들이 존재하고 있고 비제도적 측면으로는 지방의원과 지방자치단체장의 역할 및 자질 부족, 중앙정부의 지방자치단체에 대한 불신풍조, 주민의 자치행정 참여기회 축소 등과 같은 문제점들을 지적할 수 있다. 따라서 이러한 문제점들을 해결하기 위해서는 무엇보다도 지방자치의 주체이자 그 객체인 주민의 적극적 참여가 필요하며 그것이 지방자치의 성공을 보장하는 중요한 요소라고 생각된다.

Local autonomy in Korea is being carried out by the interaction between the Council and the Executive that are two pillars of the local autonomy. Long-term and serious conflicts between two institutes may cause chaos in local autonomy. The study examines the conflictual relationship between the Local Council and the Chief Executive of Local Government, and suggests solutions to such problems on the basis of the findings from the examination in a viewpoint of separation of powers. The conflicts between the two institutes are not as serious or frequent as worried. However, despite the low level of conflicts, negative implications of the conflicts appear to be somewhat serious. This suggests that there is a necessity to systematically survey and analyze the conflicts and to come up with measures to solve the conflicts. Therefore, the conflicts between the two institutes are mostly caused by such factors as formality, procedure and system than by factors like policy differences. This suggests that many conflicts are counter-productive and unnecessary. However, most of respondents appear to believe institutes change their relevant perceptions and behaviors.
