Local Governmental Solutions for Street Vending Problems

노점상에 관한 우리나라 지방자치단체의 방침은 가로 정비의 목적에 따라 노점을 근절하는 것이다. 하지만 노점상은 불법행위와 동일한 차원의 개념이 아니므로, 오히려 지방경제와 주민복지의 차원에서 단속 일변도보다는 보완적인 대안을 찾고자 하는 노력이 필요하다. 노점상을 직업으로 선택하는 논리는 공식영역에 대한 진입이 어려운 상황에서 비공식영역인 노점상이 진입도 용이하고 이익도 초래할 수 있기 때문이다. 따라서 지방자치단체는 미국의 대도시 정부처럼 전면적인 노점 허가제를 실시하기보다는 우선 노점 등록제와 실명제를 대폭 개선하여 노점상의 공식화를 도모하는 것이 필요하다. 또한 때로는 복지의 차원에서 빈곤층 주민의 노점상을 허용하는 방안도 필요하다. 정책 대안의 목표는 노점상인과 지방자치단체의 이해관계를 일치시키는 것이다.

The current policy of Korean local governments on street vending is to eradicate it for the purpose of street maintenance. The concept of street vending, however, is not identical with that of illegal behavior. Rather, it is desirable, in terms of local economy and resident welfare, to find a complementary alternative to command and control in making administrative arrangements for this problem. The logical reason to choose street vending as one s own occupation is that, to some kinds of people, street vending may be easier to start and more profitable than formal economic activities. Our local governments, therefore, are recommended to try to formalize street vending more positively. These types of governmental effort may include the institutional reform of the registration and identification of street vending, whereas American metropolitan governments issue licenses to street vendors in a more reasonable fashion. It is also recommended to take a more generous position to street vendors in extreme poverty for the purpose of welfare. The policy alternative is aimed at reaching a consensus of interests between street vendors and local governments.
