일본 지방자치단체의 개인정보보호제도와 법적 통제에 관한 고찰

A Study on Protection of Personal Information System and Legal Control of Local Government in Japan: Focusing on Ordinances regarding Protection of Private Information

개인정보의 가치가 증대됨에 따라 개인정보 침해사고가 빈번히 발생하고 있는 가운데, 정보프라이버시권을 보장하기 위한 정부규제의 필요성이 강조되고 있다. 우리나라는 ‘공공기관의 개인정보보호에 관한 법률’ 개정을 통해 컴퓨터로 처리되는 개인정보보호를 위한 법적 규제를 수행하고 있으나, 지방자치단체에서는 아직 구체적인 조례 제정이 이루어지고 있지 않은 실정이다. 그러나 중앙정부의 개인정보보호에 관한 법률이 개정된 점, 지방자치단체 등 공공기관의 개인정보 누출사고가 끊임없이 발생하고 있는 점 등을 고려할 때 조만간 지방자치단체에서도 개인정보보호를 위한 조례 제정이 이루어질 것으로 예상된다. 이에 일찍이 개인정보보호조례를 제정 및 운영하고 있는 일본 사례를 분석함으로써 우리나라 개인정보보호조례 제정에 시사점을 제공하는 것이 본 논문의 목적이다. 본 논문에서는 Riley의 정보관리의 통제이론에 기초하여 조례내용을 사전통제, 운영통제, 가부통제, 사후통제로 구분한 뒤 일본 사례를 분석하였다. 일본사례의 자료로는 일본 내각부가 2006년 조사한 개인정보보호 시행상황 보고서의 자료(2005.4.1~2006.3.31)를 기초로 하였다. 분석결과에 따르면 일본의 개인정보보호조례의 경우 사전통제 및 운영통제가 90% 이상으로 높게 나타나 주로 개인정보보호 환경의 구축 및 개인정보 관리에 대한 통제를 강조하고 있음을 알 수 있다. 사전통제에는 개인정보의 대상, 분류, 교육 등이 포함되고, 운영통제에는 개인정보 주기별 관리내용이 포함되어 있다. 규제 내용 중 개인정보보호 교육 및 민간사업자의 관리 규정 등은 우리나라의 개인정보보호조례 제정시 고려할 만한 사항이라고 할 수 있다. 일본사례 분석을 통해 본 논문에서는 자치단체에게 개인정보보호 환경구축, 정보공개와 개인정보보호의 연계, CIO의 관심 및 교육 등을 시사점으로 제시한다.

The study is to analyze the structure and contents of the ordinance of Protection of Personal Information(PPI) of local government in Japan and to suggest legal policies for protection of personal information of local government in Korea. In Japan, the General law on the protection of personal information came into force in April, 2005. It provides the basic and comprehensive privacy enforcement system for both public and private sectors. PPI of Central Government affected on making local government s act. This paper analyzed PPI of local government in Japan by Riley s the control theory of information management. According to Riley s model, the type of legal control are Pre-control, Operation control, Communication control, and Post control. The data for this study is based on the report examined on 2006 by Cabinet office Government of Japan. The result of this study is as follows. Ordinance regarding PPI of local government in Japan emphasized Pre-control and Operation control system. Especially it emphasized the management system for personal information protection and the management of personal information. It is considered to be important part for the establishment of PPI system of the Korean local government. Also, It suggests that the relation of information disclosure and intensification of penal provisions, CIO s interest and PPI education are the important factors Protection of Personal Information(PPI) of local government in Korea
