현재 5･18 3단체와 5･18기념재단에 관해서는 일반법인 ｢국가유공자 등 예우 및 지원에 관한 법률｣, ｢민주유공자 예우에 관한 법률 제정(안)｣, ｢민주화운동 관련자 명예회복 및 보상 등에 관한 법률｣,｢국가유공자 등 단체설립에 관한 법률｣은 적용되지 않고, 개별적 법률의 성격을 갖는 ｢5･18민주화운동 관련자 보상 등에 관한 법률｣, ｢5･18민주화운동 등에 관한 특별법｣, ｢5･18민주유공자 예우에 관한 법률｣이 적용된다. 본 연구는 민주화운동 관련 각 단체의 법적 성격 및 법적 근거를 5･18기념재단과 비교분석하고, 5･18 3단체의 공법단체 설립 추진 현황과 전략 및 공법단체에 가입될 경우 5･18기념재단과의 관계 설정을 검토하며, 관련 법률의 개정입법 추진 등 법적 쟁점을 검토한다.
The Act on the Honorable Treatment and Support for Persons of Distinguished Service to the State, the Act on the Honorable Treatment and Support for Persons of Distinguished Service to the Democratic People, the Act on the Restoration of Honor and Compensation for Persons related to the Democratic Movement, and the Act on the Establishment of Organizations, such as Persons of Distinguished Service to the State, are not applied to the current May 18 Related Organizations. But the May 18 Related Organizations are applied to the Act on the Restoration for Persons related to the May 18 Democratic Movement, the Special Act on the May 18 Democratic Movement, and the Act on the Honorable Treatment for Persons related to the May 18 Democratic Movement. This study compares and analyzes the legal nature and legal basis of each organization related to the democratization movement with the May 18 Memorial Foundation, reviews the current status of the 3 May 18 organizations push for the establishment of a public law organization, strategies, and the establishment of relations with the May 18 Memorial Foundation if they join in public law organization, and reviews optimal legal strategies such as promoting revised legislation to strengthen the legal status of the May 18 Memorial Foundation.
