공정거래법상 카르텔 집행체계의 개선방안

A Study on the Improvement of Enforcement System against Cartels

최근까지도 경쟁법 집행체계에 대한 논란이 지속되고 있는데, 오랜 법률적 실제와 관행을 하루아침에 개혁하는 것에 대한 막연한 두려움에서 오는 저항이 근본적인 원인이라 할 수 있다. 전면적인 변혁에 어려움이 있다면, 부분적인 변화부터 시작하는 것도 하나의 방법일 수 있다. 이 글은 경쟁법 집행체계의 개혁을 위한 단계적 접근의 일환으로 우리 공정거래법이 금지하고 있는 행위유형 중 가벌성이 가장 선명한 카르텔을 논의의 대상으로 삼았다. 특히 카르텔에 대한 집행체계 중에서 행정집행과 형사집행으로 구성되는 공적 집행의 합리화 방안을 중심으로 논의를 진행하였다. 결론적으로 공적 집행체계의 두 축으로서 행정집행과 형사집행은 별개의 문제가 아니라 할 수 있어서 카르텔 형사집행 시스템의 개선을 위한 해답은 경쟁법 집행에 있어서 이원적 집행을 강화하는 것에 있다고 보았다. 다시 말해서, 미국의 경쟁법 집행체계에서 나타나는 것과 같이 공적 집행의 관할을 전속적으로 구분함으로써 공정위와 검찰의 역할을 명확하게 나누어 권한의 중복 내지 충돌을 차단하는 것이 가장 바람직한 방안이다.

In August 2017, reformation of the Fair Trade Act was discussed by ten persons from economic organization, citizens, consumer groups and concerned persons of the Ministry of Administration and the Ministry of Justice. The attendants agreed with reformation of system of the competition act. Exclusive accusation system is main issue of competition act system because of fear to reformation of legal practice. A partial reformation can be a way. The study firstly discussed cartel with punishment of the Fair Trade Act to get access to reformation of the competition act as well as rationalization of official execution of administration and criminal. At first, the study examined execution system and problems of the cartel (part Ⅱ), followed by reformation (III) and strengthening of dual execution (Ⅳ). In summary, official execution of administration and criminal to strengthen the competition act. The official act shall be divided depending upon the committee of fair trade and the execution service to prevent overlap and conflict.
