불법체류자 범죄에 대한 경찰권 행사의 법적 한계와 대응방안

A review on the legal countermeasure and the limitation of policeauthority to illegal immigrants crimes

21세기 들어 세계화·개방화가 급속도로 진행되고, 저출산·고령화로 인한 국내 경제활동인구의 감소로 외국인 노동자 등이 국내에 대거 유입되고 있다. 이러한 현상은 불법체류자의 양산을 초래하고 있으며, 이들에 의한 다양한 범죄가 발생하고 있다. 이러한 불법체류자의 범죄에 대하여 경찰 등 관계기관은 불법체류자에 의한 범죄를 철저히 관리하고 강력히 억제하라는 국민적 요구에 직면해 있으며. 범죄에 대응하고 해결하기 위하여 다양한 수단을 강구하고 있으나 실효를 거두고 있지 못하고 있다. 이에 본 연구는 불법체류자 증가와 그들의 범죄를 실효적으로 관리하고 억제하는 데 기존의 대책만으로는 한계점에 이르렀다고 판단하고 법적 관점에서 불법체류자의 범죄에 대한 대응과 관련한 관계법령의 한계점을 제시하고 한계 쟁점이 되는 법 조항을 비판적인 관점에서 해석하여 법률의 개정, 관련 법 조항의 신설 등 입법 정책적으로 대응방안을 모색하였다.

In the 21st century, globalization and openness are rapidly progressing, and foreign workers and others are flowing into Korea due to a decrease in the number of economically active people in Korea due to low birth rate and aging population. This is the beginning of mass production of illegal immigrants, and various crimes are being committed by them. In response to crimes committed by illegal aliens, the police and other related agencies should thoroughly manage and strongly restrain crimes committed by illegal immigrants. In response, this study found that the existing measures alone reached the limit in managing and suppressing the increase in illegal immigrants and their crimes effectively, and sought legislative policy solutions such as revising laws and establishing new clauses by presenting limitations of relevant laws and regulations related to the response of illegal aliens from a legal perspective and interpreting them from a critical perspective.
