수형자의 규율위반행동에 대한 교도소 내 프로그램 참여의 역설적 효과

The Paradoxical Effect of Participation in Prison Programming on Inmate Rule Violations

교도소 내 프로그램 참여와 재소자의 출소 후 재범간의 관련성에 대한 연구는 활발히 이루어져 온 반면에, 교도소 내 프로그램 참여가 수형자의 규율위반행동에 어떠한 영향을 미치는가에 대한 경험적 연구는 상대적으로 매우 미흡하다. 따라서 본 연구는 다양한 형태의 프로그램 참여와 교도소 내 수형자들의 규율위반행동 간의 관련성을 살펴보고자 하였다. 특히, 본 연구는 기존의 전통적 입장에서 벗어나 범죄학 이론인 생활양식 및 일상활동 이론을 적용하여 수용자의 규율위반행동을 설명하고자 하였다. 이를 위하여 미연방 법무부 산하 사법통계국의 주·연방 교도소 수형자에 대한 설문조사 데이터를 활용, 총 14,051명의 표본에 대하여 로지스틱 회귀분석을 실시하였다. 분석결과, 종교활동 프로그램 참여를 제외한 주요관심 변수인 교정프로그램 참여는 대체적으로 수용자의 규율위반행동을 증가시키는 것으로 나타났다. 이에 과연 어떠한 교정프로그램이 수용자의 행동을 변화시킬 수 있는 것인가에 대한 정책적 함의 및 시사점을 논의하였다.

There has been a multitude of research examining the relationship between prison program participation and recidivism while ignoring the possible linkage between participation in prison programs and inmate misconduct. The current study sought to fill in this gap in the literature and attempted to clarify the relationship by examining the effect of several types of inmate programming upon inmate misconduct while simultaneously adjusting for other factors that have been found to be correlated to inmate rule violations. This study estimated binary logistic regression using nationally representative data from the 2004 Survey of Inmates in State and Federal Correctional Facilities (SISFCF; Inter-University Consortium for Political and Social Research[ICPSR], 2007). The results indicated that participation in prison-based treatment programs led to more prison infractions in general, with the exception of involvement in religion programs which reduced the possibility of an inmate becoming a rule breaker. Policy implications and suggestions for future research are discussed.
