낙태죄 헌법불합치 결정과 한국교회의 생명운동

Constitutional Court s Decision of Unconformable to Constitution for Criminal Abortion and Pro-life Movement of Korean Catholic Church

2019년 4월 11일 우리나라 헌법재판소는 헌법불합치 4명, 단순위헌 3명, 합헌 2명의 의견으로 낙태죄 조항(형법 제269조, 제270조)에 대해 과잉 금지원칙 위반으로 판단하여 ‘헌법불합치’ 결정을 내렸다. 생명을 수호해야 한다는 점에 대해서만큼은 헌재 재판관 9인 모두 동의했지만 임신초기의 낙태까지 전면적ㆍ일률적으로 금지하고 처벌하는 것은 “임신한 여성의 자기결정권을 침해”한다고 판시했다. 인간존엄과 자기결정권은 서로 대립될 수 있는 개념들이 아니다. 이는 목적과 수단이라는 서로 다른 층위에 있기 때문이다. 자기결정권은 인간존엄을 실현하기 위한 수단이며, 인간존엄이야말로 자기결정권의 근거이자 동시에 목적이다. 우리나라 가톨릭교회는 낙태를 ‘태아 살해’로 간주하고 낙태죄 폐지에 관한 여론과 결정들에 대해 매우 일관되고 강경한 대응을 해 왔다. 본 연구를 통해 헌재 결정이 가진 의미들에 대해 살펴보고 낙태죄 완전폐지가 가져 올 무분별한 생명 침해를 막기 위해 그간 가톨릭교회의 노력을 정리해 보는 한편, 이후 어떤 대응을 해야 하는지에 대한 방향을 고민해 보고자 한다.

On April 11, 2019, the Constitutional Court of Korea decided constitutional nonconformity to the criminal abortion (Article 269 and 270 of the Criminal Code) by judging it as a violation of the proportionality with the opinions of constitutional nonconformity (4 out of 9), violation of the constitution(3 out of 9), and constitutionality(2 out of 9). All nine justices of the Constitutional Court agreed that life should be protected but the court decided that banning and punishing abortions completely and indiscriminately even in the early stages of pregnancy violates the right of self-determination of pregnant women. Human dignity and self-determination are not mutually opposite. This is because their purpose and means are different. Self-determination is a means of realizing human dignity, and human dignity is the basis and purpose of self-determination. The Catholic Church in Korea regards abortion as fetal murder and did a very consistent and tough response to public opinion and decisions regarding the abolition of abortion laws. The purpose of this study is to examine the meaning of the Constitutional Court s Decision and to find out how the Catholic Church has been making efforts to prevent thoughtless violations of resulting from the complete abolition of abortion, and to suggest how to take action against it.
