여객선 안전운항관리 방해행위에 대한 형사법적 대응방안

A study on possible criminal measures against acts of hindering enforcement of passenger-ship safety inspection

내항여객선은 철도, 항공, 여객자동차에 비하여 안전운항관리 방해행위에 대한 처벌규정이 제대로 마련되어 있지 않다. 여객선분야 여객금지행위 처벌규정이 항공이나 철도분야와 비교하였을 때 유사한 위반행위에 대하여 상대적으로 가볍게 처벌하고 있음을 고찰하였다. 이 논문에서는 먼저 여객금지행위, 시설보호 및 질서유지 관련 처벌규정, 직무집행관련 범법행위 처벌규정 등 교통분야별 안전운항(운행)관리 방해행위 처벌규정을 분석하고, 다음으로 여객선 안전운항관리 방해행위의 법률기반과 사례 실증연구를 통해 실태를 분석하여 내항여객선 안전운항관리의 문제점을 도출하고, 각 교통분야별 안전운항(운행)관리 방해행위 처벌규정 등 비판적 고찰을 통해 제약요인과 시사점을 도출하여 형사정책적 대응의 필요성을 제기하며, 형사법적 법제 정비를 통한 여객선 안전운항관리 방해범죄에 대한 위하력 확보방안을 제시하고자 한다. 이 논문에서는 안전운항관리 종사자에게 폭행･협박･위력 등을 사용하여 직무를 방해한 자는 철도, 항공, 자동차분야의 처벌규정과 같이 무겁게 처벌할 수 있도록 가중처벌 규정을 신설하도록 제안하였다.

Disturbance with respect to coastal passenger-ships has been less regulated by the legislative provisions such as criminal sanctions, comparing other types of transport including rail, air and road public transportation. This paper examines that the level of sentence has been set out with less penalties for the offence of disturbance on coastal passenger-ships, comparing penalties for similar offences in air or rail transportation. This paper explores regulations in relation to hindering enforcement of transport safety inspection, focusing the prohibited acts of passenger, legislations for public facilities protection and public orders, offence against law enforcement and other relevant law in relation to prohibited acts against safety operation of public transportation. Then, in order to find matters to be dealt for taking measures against acts of hindering enforcement of passenger-ship safety inspection, the paper examines these regulations based on their legal basis and cases in regards to prohibited acts for passenger-ship safety inspection. Also this paper critically analyzes implications of regulations with respect to acts of hindering enforcement of transport safety inspection according to each type of public transportation, and then finds needs for political measures against the acts of hindrance. As a conclusion, the paper will suggest necessary amendment to current criminal codes, which would deter acts of hindering especially enforcement of passenger-ship safety inspection. This paper suggests to introduce an aggravated punishment for assault, threat, and duress that can be committed by a person against a personnel engaging passenger-ship safety inspection, referring to the regulation of punishment in the vehicle transportation system.
