『대한국국제』의 분석과 각국 헌법

‘Daehankookkookjae(大韓國國制)’ and Constitution of Each Country

대한제국의 역사적 성격을 파악하는 데 가장 기초가 되는 법률체계는 1899년 8월 17일 공표된 『대한국국제(大韓國國制)』다. 이 논문은 19세기 서양 각국의 흠정헌법과 『대일본제국 헌법』에 큰 영향을 준 프랑스의 1814년 헌법헌장 을 비롯한 주요국의 흠정헌법 제정과 이를 이어받는 과정을 살폈다. 또한 『대한국국제』의 9개 조항 작성에 이들 각국 헌법이 직간접적 영향을 준 것으로 이해하고 이에 해당하는 법률을 각 조항별로 비교 분석하여 그 유사성과 차별성을 정리하였다. 군주권의 절대화를 추구하던 각국 헌법들의 전반적인 내용은 프랑스의 『헌법헌장』을 모티브로 하면서 러시아와 프로이센, 일본과 대한제국이 선행 법전들을 참고하고 이를 자기 나라의 실상에 맞게 다듬어 간 것으로 판단된다. 즉, 군주권 강화 내용은 1814년 4월과 6월 프랑스의 두 가지의 헌법이 러시아에 전파되었다. 한편에서는 프랑스헌법의 영향을 받은 프로이센(독일)을 통해 일본에 전파되었고, 여러 가지 군주제 헌법들이 『공법회통』과 융합되어 『대한국국제』에까지 영향을 미쳤던 것으로 보인다.

The most basic legal system to identify the historical character of the Great Han Empire is the ‘Daehankookkookjae’ published on August 17, 1899. This paper has looked into the establishment of constitution granted by the king of major countries including ‘Charte Constitutionnelle’ of France in 1814 made great influence on constitutions granted by the king of western countries in nineteenth century and ‘Great Japanese Imperial Constitution’ and the process of taking over this. In addition, by understanding that these constitutions of each country had directly or indirectly influenced on the creation of 9 clauses of ‘Daehankookkookjae’ the similarities and differences were summarized through the comparison and analysis of the applicable laws by each clause.
