조선 초기 국왕의 法 인식을 통해 본 對民 인식

State perception of the people through the recognition of law by the king in the early Joseon period -Focusing on Taejong and Sejong-

본고는 조선의 대민 인식을 국왕의 법 인식과 법률 시행이라는 측면에서 살펴보았다. 조선사회의 산적한 과제를 해결하고 진전된 사회를 만들어가는 것은 그 사회의 합의, 즉 법률로귀결되었다. 따라서 안정적인 법 시행은 개혁의 일관성과 관련되었고, 이는 곧 인민들로 하여금 국가의 개혁 방안을 신뢰하도록 만드는 것이었다. 조선은 經典과 史書의 제도를 검토하여 조선의 실정에 맞춰 채택하고, 이 제도가 안정적으로실현될 수 있도록 조치해야 했다. 안정적 실현을 위해서는 법적 안정성 확보, 다시 말해 법의지위를 확고히 해주는 것, 법의 예외를 허용하지 않는 것, 법의 취지와 내용을 인민에게 알려주는 것 등이었다. 이러한 조치들은 인민들을 대하는 국가의 방식이 일방적인 통보 및 집행에서쌍방향 소통을 지향했다는 측면에서 의의를 갖는다고 생각한다. 조선은 민에게 법 시행 뿐 아니라 법의 취지를 이해하고 자발적으로 따라주기를 바랬다. 독법령은 전 인민을 대상으로 한 법 교육이라는 측면에서 주목할 만하며, 조선 초기 국가의 대민 인식을 잘 보여주는 제도라 할 수 있다. 법과 제도에 대한 민의 충분한 이해와 그에따른 민의 자발적 준수, 이것이 법을 잘 아는 민으로 인한 부작용을 우려하면서도, 조선이민에게 信義를 구축하고자 한 이유였다. 주목되는 것은 민 스스로도 자신의 위상을 자각하고 있었다는 것이다. 적극적인 정소나불만 제기 등은 국가에게 자신들의 의견을 피력할 수 있다는 인식으로부터 비롯된 행동이었다. 결국 민들은 스스로 자신의 위상을 자각하고 있었고, 국가는 그러한 민의 위상에 기반하여법을 제정하고 시행하고 있었던 것이다.

The thesis studied the state s perception of the people from the perspective of the king s law perception and law enforcement. Joseon solved the problems accumulated from Goryeo through law and created an advanced society. Therefore, stable law enforcement was related to the consistency of reform. And this was to make the people trust the state s reform plan. Chosun reviewed the classics and then modified them to suit reality. For the realization of this system, the position of the law was established, exceptions to the law were not allowed, and the purpose and contents of the law were informed to the people. These measures show that the state and the people are aiming for two-way communication. Joseon wanted its people to understand the purpose of the law and voluntarily follow the law and its enforcement. The people s full understanding of the law and the system, and the voluntary compliance of the people accordingly, were the reasons why the Joseon tried to build loyalty to the people while worrying about the side effects caused by the people who knew the law well. What is noteworthy is that the people themselves were aware of their status. Active complaints were raised from this recognition. After all, the people were aware of their status, and the state was enacting and implementing laws based on that status.
