해상운송계약상 운송인의 감항능력주의의무 입증책임에 관한 연구

A Study on Carriers’Burden of Proof toward Caring Their Seaworthiness under the Contract of Carriage of Goods by Sea

감항능력담보는 선주가 장기운송계약에 명시된 물품을 운송하거나 항해를 위해 항해에 적합한 선박을 제공하는데 동의하는 담보를 의미한다. 감항능력은 선박 또는 기타 선박이 가능한 안전하게 항해를 할 수 있는 능력이다. 항해보험에는 부보한 특정 모험을 위해 선박이 항해에 감내해야 한다는 묵시담보가 있다. 이것에는 의도된 용도에 합리적으로 적합한 선박, 선원 및 부속품을 제공하는 소유자의 절대적인 의무가 포함된다. 해상화물 운송인은 발항시 선박이 항해에 감내할 수 능력을 가지고 있다는 것을 화물의 송하인에게 부담할 의무가 있다. 선주는 용선중인 선박이 항해에 감내할 수 있다는 것을 용선자에게 담보한다. 마찬가지로 선박건조자는 건조중인 선박이 항해에 감내할 수 있다는 것을 담보한다. 해법은 선박, 승무원 또는 그 부속품의 결함 또는 불충분함으로 인해 선박의 감항능력을 결여하거나 의도된 용도에 부적합하게 됨에 따라 초래된 부상에 대한 소송 원인을 규정하고 있다. 본 연구에서는 운송인의 감항능력주의의무를 중심으로 운송인의 책임원칙을 고찰한다.

Purpose : This study aims to analyze the burden of proof on carriers in ensuring their seaworthiness under the contract of carriage of goods by sea. Research design, data, methodology : Focusing on the duty of carriages to provide warranty of seaworthiness a literature review of academic papers on the topic was conducted, and Internet data were analyzed. Results : Warranty of seaworthiness refers to a warranty whereby the ship-owner agrees to provide a seaworthy vessel to carry the goods specified in a contract of affreightment or for voyage. Seaworthiness is a concept that runs through maritime law in at least four contractual relationships. In a marine insurance voyage policy, the assured warrants that the vessel is seaworthy. A carrier of goods by sea owes a duty to a shipper of cargo that the vessel is seaworthy at the start of the voyage. Conclusions : The following are a few rules established with regard, to the warranty of seaworthiness. Maritime law provides a cause of action for injuries resulting from defects or insufficiencies of a vessel, its crew, or its appurtenances that undermine the vessel’s seaworthiness, render it unfit for its intended use, or make the vessel an unsafe place to work.
