북한 기업소법상 경영권의 법적 성격

The legal nature of the right of management in the DPRK Enterprise Act

북한 기업소법상 경영권은 사회주의기업책임관리제의 핵심범주임에도 불구하고 그리 많이 논의되지 않았다. 기업소법은 그것을 주동적이고 창발적인 기업활동을 위해 경제적 공간을 활용할 권리로 이해한다. 이러한 경영권은 다음과 같은 과정을 거쳐 등장했다. 먼저 독립채산제 하에서 채산을 맞추기 위한 방법으로 기업소 상호 간 생산수단의 교환이 허용되는데 이 때 가치법칙을 적용할 수 있는지 문제된다. 이 문제를 해결하는 과정에서 개념적 기초로서 등장한 것이 바로 경영상 상대적 독자성 개념이다. 그리고 이것은 기업소의 법인 자격과 권리에서 법적으로 표현된다. 그러한 권리로는 북한 민법의 경영상 관리권과 기업소법의 경영권을 들 수 있다. 경영상 관리권의 내용이 재산의 관리에 한정되는 데 반해 경영권의 그것은 노동의 지휘와 기업관리의 화폐적 측면도 포함한다. 기업소법상 경영권은, 경영상 관리권과 마찬가지로, 순전한 재산상 권리가 아니라 책임과 권한으로 이해된다. 그럼에도 불구하고 경영권은 여전히 권리라고 할 수 있다. 이러한 권리에는 의무적 요소가 내재되어 있고 따라서 그것을 일종의 ‘사회주의적 권리’ 개념으로 볼 수 있다.

Although the right of management in the DPRK Enterprise Act can be regarded as key category to the socialist enterprise management system, it has not drawn as much attention as it deserves. It is conceived by the Act as the right to use economic levers. The right has come to the surface as follows: The independent accounting system allows state-owned enterprises to exchange productive means with each other so that they can make ends meet, whereby the problem was if the law of value applies. What had served as a conceptual basis to solve this problem is the managerial autonomy, which has in turn found its legal expressions in the legal person status and the rights of the enterprise. Among those rights one can count the right of operative management in the Civil Act as well as the right of management in the Enterprise Act. The former comes down to the management of the properties of the enterprise, whereas the latter goes so far as to cover the area of labor and financial management. The right of management is, as is also the case for the right of operative management, not understood to be a mere property right, but to be the responsibility and competence of the enterprise. One cannot nevertheless deny to it the character of a right. With elements of obligation inherent in it, however, it can be construed to embody the socialist concept of right.
