블록체인 선화증권과 로테르담규칙에 관한 연구

A Study on the Blockchain Bill of Lading and Rotterdam Rules

블록체인 기술이 급속히 도입되면서 선화증권에 블록체인 기술이 접목되어 블록체인 선화증권이 개발되어 상용화될 시점에 있다. 블록체인 선화증권이 상용화되기 때문에 국제적으로 법률적인 기반이 마련되어야 하는데 그 법률적인 기반이 바로 로테르담규칙이라고 할 수 있다. 로테르담규칙은 다른 국제운송규칙과 달리 전자운송기록 특히 유통가능 전자운송기록을 규정하고 있어블록체인 선화증권에 적용될 수 있는 국제무역규칙인데 이를 위해서는 우선 20개국이상이 비준하여 발효되도록 하여야 한다. 따라서 본 논문은 블록체인 선화증권의 기능을 살펴봄으로써 로테르담규칙이 블록체인 선화증권에 적용가능한 범위를 살펴보고 로테르담규칙이 블록체인 선화증권에 도입될 수 있도록 동 규칙의 비준에 필요성을 인식시킴으로써 블록체인 선화증권의 활성화에 기여하는 것을 그 연구목적으로 한다. 로테르담규칙을 블록체인 선화증권에 적용하는데 어떤 문제점도 없기 때문에 로테르담규칙이 블록체인 선화증권이 적용될 수있다면 전자선화증권으로서 블록체인 선화증권의 활성화에 기여할 수 있을 것이다. 본 협약이 발효되기 위해서는 20개국의 비준이 필요한데 현재 25개국이 서명하였고 5개국이 비준을 한 상태에서 비준까지는 상당한 기간이 소요될 것으로 보인다. 로테르담규칙은 전자무역의 활성화를 위해서도 반드시 발효될 필요가 있으며 가능한 한 빨리 각국 정부가 로테르담규칙의 비준을 하여 국제해상운송에 있어서 전자선화증권으로서 블록체인 선화증권이 사용될 수 있는 법적인 토대가 마련되어야 한다.

With the rapid introduction of the blockchain technology, it is time for the development and commercialization of the blockchain bill of lading by incorporating the blockchain technology into blockchain bill of lading. Since blockchain bill of lading is commercialized, a legal foundation must be established internationally, which is the Rotterdam rule. Unlike other international transport rules, Rotterdam rules stipulate electronic transport record, especially negotiable electronic transport record, which can be applied to blockchain bill of lading, and for this purpose, more than 20 countries must ratify this rule. Therefore, by examining the function of the blockchain bill of lading, this paper aims to contribute to the activation of the blockchain bill of lading by examining the extent to which Rotterdam Rules are applicable to blockchain bill of lading and recognizing the need for the ratification of these Rules so that Rotterdam Rules can be applicable to blockchain bill of lading. Since there is no problem in applying Rotterdam Rules to blockchain bill of lading, if Rotterdam Rules can be applied to blockchain bill of lading, it could contribute to the revitalization of blockchain bill of lading as an electronic bill of lading. In order to make these rules be in force, ratification by 20 countries should be required, as these rules are currently ratified by 5 countries and it takes a considerable period of time for these rules to be effective with 25 countries signing. Rotterdam rules must be in force to promote electronic trade, and each government must ratify Rotterdam Rules as soon as possible to lay the legal foundation for the use of the blockchain bill of lading as electronic bill of lading in international sea transport.
