지방자치단체의 남북교류협력 활성화를 위한 입법론적 검토

Legislative Reviews to Promote Inter-Korean Exchange and Cooperation by Local Governments

중앙정부만이 통일의 주체가 되는 것은 아니다. 통일에 관한 사무를 국가의 독점적 사무로만 보기는 어려운 것이다. 따라서 정치적 상황에 따라 변동은 있을지라도, 남북의 교류와 통합의 과정에서 지방자치단체의 역할론은 앞으로도 지속적으로 등장할 것이다. 지방자치단체의 남북교류협력을 활성화하기 위해서는 지방자치단체의 역할 강화 및 지속적이고 안정적인 추진 기반의 마련 등이 필요하고, 이를 위한 근거 입법의 제정이 시급하다고 본다. 남북교류협력에서의 지방자치단체의 주체성 인정 문제, 남북교류협력사업을 추진하는 지방자치단체에 대한 중앙정부의 재정 지원, 지방자치단체가 추진하는 협력사업의 특례 규정 마련, 중앙과 지방자치단체, 그리고 지방자치단체 간의 협의체의 설치, 지방자치단체 남북교류협력사무만을 전담하는 조직의 구성 및 전문인력의 운영, 지방자치단체 남북교류협력에 관한 전반적인 사항을 담은 계획의 수립･시행과 이를 위한 별도의 위원회 설치 등을 도입･실현하거나 해결하기 위해서는 독자적인 법률의 제정을 통하는 것이 가장 효율적이거나 근본적일 수 있다. 이에, 본 연구에서는 이러한 사항들을 입법적으로 규율하기 위해 총 22개의 조문으로 구성된 가칭 ｢지방자치단체 남북교류협력에 관한 법률｣ 제정안을 제안하였다.

The central government is not the only subject of unification. It is difficult to view the affairs related to unification as exclusive affairs of the state. Therefore, although there may be fluctuations depending on the political situation, the role theory of local governments in the process of inter-Korean exchange and integration will continue to emerge in the future. In order to revitalize the inter-Korean exchange and cooperation by local governments, it is necessary to strengthen the role of local governments and to establish a basis for continuous and stable implementation, and it is deemed urgent to enact the foundational legislation for this. The main legislative matters are the issue of recognition of local governments identity in inter-Korean exchange and cooperation, financial support from the central government for local governments promoting inter-Korean exchange and cooperation projects, and provision of special rules for cooperative projects promoted by local governments. In addition, there are also legislative matters such as the establishment of a consultative council between the central government, local governments and local governments, the formation of an organization dedicated only to inter-Korean exchange and cooperation affairs for local governments and the operation of professional personnel, and the implementation of a plan that contains general matters on inter-Korean exchanges and cooperation by local governments and the establishment of a separate committee. In order to introduce, implement, or solve these legislative matters, it may be the most efficient or fundamental to enact a total independent law. Therefore, in this study, in order to legislatively regulate these matters, a tentatively named ｢Act on Inter-Korean Exchange and Cooperation by Local Governments｣ was proposed.
