화재사건 수사의 문제점 및 개선방안

Fire incident investigation problem and improvement plan : Focusing on police fire detection activities

최근 들어 발생한 대형 화재 사건에서 1차 대응 기관인 경찰과 소방의 활동에 대한 비판적 시각과 개선의 목소리가 높다. 또한, 제조물 책임법의 시행, 변호사 수의 증가, 다국적 보험사들의 국내 진출 등으로 인하여 화재조사는 형사상 혹은 민사상 책임 소재를 밝히는 근거가 되고, 피해 보상의 문제와 관련하여 그 중요성이 날로 강조되고 있다. 이에 대한 우선적 해결 과제로 경찰과 소방의 이원적 화재조사체계로 인한 실무상 문제점에 대한 검토와 함께 사법적 환경변화에 적응하기 위한 화재 수사 절차상 화재감식 활동과 관련한 법적 검토가 필요하다. 따라서, 본 논문에서는 우선 현행 화재조사체계의 문제점에 대하여 미국, 일본, 영국 등 주요국의 법제를 통해 비교 분석을 한 후, 경찰 수사 활동으로써 화재감식의 문제점에 대하여 법적 검토를 통한 개선방안을 모색해 본 결과, 첫째, 현행 화재조사체계에 대하여 화재조사의 공적 신뢰도 향상 및 피해자의 권익 보호를 위한 조치가 요구되고, 이에 대하여 법률의 보완이나 공적 기관 상호 간의 업무협약 등을 통한 화재조사의 우선순위의 명확화 및 공조 강화를 위한 법적‧제도적 개선의 필요성이 있음을 확인하였다. 둘째, 공판중심주의 강화와 국민참여재판의 시행 등의 사법적 환경의 변화에 따라 화재 사건 수사에 있어서도 수사 및 증거수집의 절차적 중요성이 강조됨에 따른 실무상 화재 수사 및 화재감식 활동에 대하여 현행 법률 검토를 통해 절차 및 증거법적 신뢰성 확보를 위한 개선의 필요성이 있음을 확인하였고, 이에 대한 개선방안 또한 제시하였다. 최근 형사소송법 개정을 통해 경찰에 실질적인 수사 개시권이 주어졌다. 이는 주어진 권한 만큼 그 책임도 크다 할 것이다. 중요한 것은 인권 또는 권리 보호를 중시하는 수사 관행과 더불어 엄격한 법규의 준수가 필요할 것이다. 또한, 모든 수사 절차에 있어서 불명확한 수사 편의적 관행을 개선하기 위하여 하위 법령의 제정을 통한 절차의 구체화 및 부가적인 제도 개선도 함께 필요할 것이다. 아울러, 과학수사의 활성화를 통하여 실체적 진실발견에 기여하고, 그 절차의 공정성과 명확성을 통하여 국민의 신뢰 향상과 함께 공감받는 수사 정의의 실현을 추구하여야 할 것이다.

In recent large-scale fire incidents, there are critical view and voice of improvement toward the police and fire department as first responders. Due to the enforcement of the Product Liability Act, the increase in the number of attorneys, and the advancement of multinational insurance companies in Korea, fire investigations become the basis for clarifying the subject of criminal or civil liability, and the importance of damage compensation is increasingly being emphasized. As priority solution to this, it is necessary to review practical problems regarding dualistic fire investigation system of police and the fire department and legal review related to fire detection activity in fire investigation procedure to adapt to the change in the judicial environment. Therefore, in this paper, first of all, after compare and analyze the problems of the current fire investigation system through the laws of major countries such as the United States, Japan, and the United Kingdom, explored improvement plan through legal review regarding problem of fire investigation as police investigation activity. First, as a result, measures to improve public reliability of fire investigations and protect victims rights and interests are required for the current fire investigation system, in regard to this, clarify of priority of fire investigation and need for legal and institutional improvement to strengthening cooperation between public organizations is confirmed. Second, in accordance with judicial environmental changes, such as reinforcement of trial-centeredness and enforcement of jury trial, procedural importance of investigation and evidence collection is emphasized even in fire case investigation. Through recent law examination of fire investigation and fire detection activity in practice, it was confirmed that there is a need for improvement to secure the reliability of procedure and evidence law and improvement measures were also suggested. The recent revision of the Criminal Procedure Act gave the police the right to initiate a substantial investigation. It would be said that the responsibility is as great as the given authority. Importantly, it will be necessary to comply with strict laws and regulations along with investigative practices that value human rights or rights protection. In addition, in order to improve unclear convenience pratices of investigation in all investigation procedures, it will be necessary to clarify procedures through enactment of subordinate laws and to improve additional systems. Also, it is necessary to contribute to the discovery of substantial truth through the activation of scientific investigations, and to improve public confidence through the fairness and clarity of the procedure and to pursue the realization of sympathetic justice for investigation.
