참사회에 관한 교회법적 고찰

Canon Law Considerations on the College of Consultors

교구 사제단을 대표하는 사제 평의회는 주교의 원로원으로서 교구의 사목적 선익이 최대한 향상되도록 교구 통치에 있어서 교구장을 보필하는 데에 그 목적이 있다. 교회법전은 사제 평의회가 교구의 사제단을 대표하는 대의기관이며 교구장을 자문하는 원로원임을 강조하고 있다. 이러한 사제 평의회 회원 가운데 교구장이 6명에서 12명 이하로 임명하는 사제들로 참사회는 구성된다. 참사회는 교구의 대표 기관이자, 때에 따라 자문과 동의를 통해 교구장의 교구 통치에 협조하는 기구로서 주로 교구의 중요한 안건을 다룬다. 교구 참사회는 주교좌 의전 사제단이 설치될 수 없었던 전교 지방을 위하여 도입된 제도이다. 주교좌 의전 사제단이 없었던 전교 지역에 특별법으로 제정된 교구 참사회 제도는 1917년 교회법전에 보편법으로 수록되었고, 1983년 교회법전에서 개정되었다. 본 연구에서는 교구의 대표 기구로 교구 통치에서 교구장을 보필하며, 교구장의 유고나 공석 시에는 교구를 임시로 통치하기도 하는 개별 교회의 대표 기관인 참사회에 대해 살펴보았다. 사제 평의회와 참사회의 제일 두드러진 차이점은 구성원의 수에 있다. 구성원의 수에 있어서 참사회가 사제 평의회보다 소수라는 점이다. 이렇게 참사회는 사제 평의회 회원 중에서 소수로 구성된 특수한 단체를 구성하여 긴급한 안건이나 비밀 준수가 필요한 경우에 교구장을 보필한다. 교구장좌 공석 때에 사제 평의회는 법규범 자체로 해산되지만, 참사회는 교구의 통치에 참여하고 교구장 직무 대행을 선출한다. 따라서 참사회는 사제 평의회의 상임 위원회 격이라 볼 수 있을 것이다. 참사회의 회원들이 사제 평의회의 회원들이지만 두 기구는 전적으로 구분되는 독립적인 기구이다. 교구 사제단의 대표들로 구성된 사제 평의회가 사제들의 의견을 적극적으로 교구장에게 개진하고, 교구장은 이러한 사제들의 의견을 적극적으로 반영하여 교구를 운영한다면 교회법전에 나타난 사제 평의회의 설립 목적과 근본 취지를 잘 달성할 수 있을 것이다. 교구의 인사 문제와 중대한 재정 문제 그리고 긴급하거나 비밀 준수가 요구되는 안건에 대하여 교구장은 참사회와 긴밀하게 논의하고 소통하면서 교구 행정 전반을 운영한다면 교구의 선익 추구에 큰 도움이 될 것이다.

The aim of the council of priests is to promote the public interest of the people of God who are delegated to the diocesan Bishop. The council of priests is superior to the other councils, which consist exclusively of Bishops and priests. The council of priests is the Senate of the Bishops representing the priests of the diocese. From among the members of the council of priests, the diocesan Bishop freely appoints not fewer than six and not more than twelve priests, who are for five years to constitute the college of consultors. The college of consultors is the representative committee of the diocese. In some cases, it is an organization that cooperates with the power of governance of the diocesan Bishop through consultation and consent. It mainly deals with urgent or confidential requirements. The great difference between the council of priests and the college of consultors is the number of members. In terms of the number of members, the number of members is smaller than the council of priests. The college of consultors shall form a special organization comprised of a small number of members of the council of priests. The college of consultors shall assist the diocesan Bishop in determining the important agenda of the diocese. At the time of the vacancy of the diocesan Bishop, the council of priests shall be dissolved by the law itself, but the college of consultors shall participate in the governance of the diocese and elect an acting a diocesan Administrator. Therefore, the college of consultors can be regarded as a standing committee of the council of priests. Although the members of the college of consultors are members of the council of priests, the two organizations are completely independent. The council of priests, composed of representatives of the priesthood of the diocese, actively expresses the opinions of the priests to the diocesan Bishop. And if the diocesan Bishop actively reflects the opinions of these priests and operates the diocese, the fundamental purpose of the council of priests as shown in the canon law will be well achieved. The diocesan Bishop shall closely discuss and communicate with the college of consultors about personnel affairs of the diocese, important financial issues, and urgent or confidential matters. If the diocesan Bishop runs the administration of the diocese, it will be of great help in the pursuit of the good interests of the diocese. If the diocesan Bishop takes rational decisions based on the premise of communicating with the college of consultors, the representative organization of the diocese, it will serve a good foundation for the growth of the diocese.
