우리나라 직업공무원의 정치적 중립 실현의 한계와 대안

The Challenges and Alternatives of Securing Political Neutrality of Civil Servants in Korea: A Case of Park’s Administration

우리 헌법은 공무원에 대한 정치적 중립을 명시하고 있어 직업공무원은 정권교체 및 변동에 관계없이 집권세력의 정치적 이익을 위해 복무하지 않고 국민의 봉사자로서 중립적인 행정을 수행해야 한다. 행정의 계속성과 안정성을 위해 직업공무원제를 근간으로 하고 있지만 선거를 통해 국민의 지지를 받은 선출자가 국민과의 공약을 정책적으로 이행하기 위해 장관 등 정무직 공무원을 임명하는 엽관제도를 보완적으로 시행하고 있다. 직업공무원제와 엽관제는 양자가 모두 장점과 단점을 가지고 있다. 이 두 제도가 조화롭게 작동하면 이상적이겠지만, 박근혜 정부에서 임명직 공무원에 의한 인사농단 사례들은 두 제도가 조화롭게 운영되지 못할 때 직업공무원의 정치적 중립을 수호하기가 매우 어렵다는 것을 보여주었다. 이에 본 연구는 직업공무원제와 엽관제도를 이론적으로 검토하며, 지난 정부에서 발생한 임명직 공무원에 의한 직업공무원의 정치적 중립 침해사례를 통해 직업공무원제 하에서 정치적 중립의 한계를 살펴보고 이를 제도적으로 방지하기 위한 대안을 제시하고자 한다.

The Korean Constitution stipulates political neutrality for civil servants. Civil servants should not serve for the political interests of the ruling forces, regardless of regime change, but should carry out neutral administration as a volunteer of the people. Although the personnel system is based on the career civil service for the continuity and stability of the administration, it supplements the system in which elected officials are appointed to fulfill their pledges with the people. Both the career civil service system and spoils system have advantages and shortcomings. It is ideal for these two systems to work in harmony. Park’s administration, however, shows that it is very difficult for the two systems to run in harmony when elected officials exert undue pressure. Thus, this study will theoretically review the career civil service system and spoils system, and though the cases of political neutrality infringement by appointed civil servants under the previous administration. We will look at the limitations of political neutrality under the career civil service system and finally suggest alternatives to prevent them systematically.
