A Study on Ensuring Independence and Impartiality of Prosecutors - focusing on international study about prosecutors based on UN guidelines on the role of Prosecutors

최근 법무부장관의 수사지휘권 행사 또는 검찰총장에 대한 징계청구 등과 관련하여 그 정당성에 대한 논의가 활발히 이루어지고 있고, 이러한 논의는 결국 우리 형사사법체계에 있어 검사의 지위와 역할은 어떠한지, 그 업무의 독립성과 공정성은 어떻게 담보하여야 하는지에 대한 근본적인 고민으로 이어지고 있다. 그간 검사 또는 검찰 제도에 대한 국내의 논의는 수사권 조정으로 대표되는 검사와 사법경찰관 사이의 권한관계 등에 대한 연구에 집중된 측면이 있었고, 그보다 본질적인 검사라는 제도의 의미와 업무의 독립성, 공정성을 담보하는 것이 어떤 의미를 가지는지에 대하여는 연구가 활발히 이루어지지 못하였던 것이 사실이다. 이에 이 논문에서는 검사의 독립성과 공정성이라는 가치에 대하여 우리나라 또는 개개 국가의 논의가 아닌 유엔(UN) 등 국제사회에서는 보편적으로 어떻게 바라보고 접근하고 있는지를 중심으로 면밀히 살펴보았고 그러한 인식을 토대로 우리나라 형사사법에서 검사란 무엇인지를 검토해보았다.

As recent debates about Minister of justice s command over crime investigation and disciplinary claim on Chief prosecutor grow more intense, it is necessary to make a thorough research on the role of Prosecutors especially focusing on independence and impartialness. As prosecutors of all countries play an essential role in Criminal Justice system, it is required to ensure independence and impartiality of prosecutors to support and promote rule of law basis and culture of lawfulness. On this basis, Eight United Nations Congress on the Prevention of Crime and the treatment of Offenders held on 1990 adopted Guidelines on the role of Prosecutors and this study researched the guideline to understand universal perception or international approach on the role of prosecutors of all countries. International study including UN guidelines, Standard of Professional responsibility and statement of the essential duties and rights of prosecutors by International Association of Prosecutors or research materials published by UNODC(United Nations Office on Drugs and Crime) agreed that any use of prosecutorial discretion should be exercised independently, be free from any undue or political interference, and Prosecutors should perform their functions impartially. Independence or Impartiality of prosecutors should be guaranteed to ensure people enjoy their right and freedom and also to promote the rule of law at national or international levels.
