공인탐정의 법적지위에 관한 고찰

공인탐정의 제도화를 위한 국회의 오랜 입법화 노력에도 불구하고 사회일각에서는 탐정업에 대하여 부정적 인식이 강한 것으로 파악되고 있다. 탐정업의 법제화를 반대하는 입장을 보면 탐정제도의 필요성 여부에 대한 반대 논리보다는 탐정업이 가지는 부작용에 대하여 우려하는 시각이 더 큰 것으로 보인다. 이는 탐정업 자체에 대한 반감 또는 그릇된 이해에서 비롯된 측면이 있으며, 탐정이라는 직업과 업무의 정체성에 대하여 이해당사자들이 올바로 알지 못하는측면도 작용하는 것으로 비춰진다. 이 연구는 최근 「신용정보법」 개정으로 탐정업에 대한 사회적 관심이 증가하고 있는 현실에서 탐정이라는 직역(職域)의 법적ㆍ사회적 정체성을 고찰해 봄으로써 국민들의 올바른 이해를 도모하고자 하는데 그 목적이 있다. 특히 이 연구에서는 탐정업의 정체성을 고찰하기 위한 방법으로서 탐정업무와가장 밀접한 분야인 ‘변호사업’을 선정하였으며, 공인탐정과 변호사를 자격요건과법적지위 등의 관점에서 상호 비교 연구함으로써 공인탐정의 정체성을 보다 구체화시키고자 하였다. 이 연구의 결과는 다음과 같다. 공인탐정의 자격요건ㆍ결격사유가 변호사처럼엄격하다는 점, 공인탐정업은 변호사와 마찬가지로 영리성과 아울러 공공성ㆍ공익성을 가진다는 점, 공인탐정은 소송과정에서 변호사의 협력자 또는 조력자로서의 지위를 가진다는 점, 변호사가 이론적 차원의 법률 및 소송 전문가인데 반해공인탐정은 현장중심의 조사전문가로서 직역이 명확히 구분된다는 점 등이다.

Despite the National Assembly s long-standing legislative efforts for institutionalization of certified detectives, it is recognized that some part of society has a strong negative perception of the detective business. Looking at the position against the legalization of the detective industry, it seems that there is a greater view of concern about the side effects of the detective business than the opposition of the need for the detective system. It is believed that this aspect stems from the incomprehension of the detective industry itself, and the aspect that stake holders do not correctly know about the profession and identity of the job as a detective is also seen to work. The purpose of this study is to seek a correct understanding of the people by examining the legal and social identity of the direct role of a detective in the reality that social interest in the detective business is increasing due to the recent revision of the 「Credit Information Act」. The results derived through the above studies are as follows. Qualifications of a certified detective are as strict as a lawyer, that a certified detective has publicity and public interest in addition to profitability like a lawyer, that it has the status of a lawyer s collaborator or assistant in the litigation process, and that a lawyer is a theoretical law And lawsuit experts, whereas certified detectives are field-centered investigation experts.
